I just got my approval notice in the mail...it says:

The above petition has been approved.the petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. The information submitted with the petition shows that the person for whom you are petitioning is not eligible to file an adjustment of status application at this time.

Ok I'm freaking out! My husband has never been to the USA, they're supposed To send the file to nvc!!!! What's going on???

Its been a year since submitting I-130 and were still in two different countries :sleepy:

Not sure what is going on but you should definitely call USCIS and speak with a Tier 2 rep. Hopefully, they can guide you. May be a mistake on their part of if your husband happens to have a common name, they may have made a mistake. Investigate by calling or setting an Infopass appt. if that helps.

Best of luck!

First calm down and call USCIS they do sometimes send the wrong letter template it happens. But you need to call to make sure you aren't sent to the black hole and disappear. They are open until 5pm.

Congratulations by the way.

**Also considering its been what a week or two since you been approved you may already be at NVC. First I would call USCIS get that straight . Make sure you ask "when was my petition mailed to the National Visa center? When did it physically leave the service center"?

Once they verify that then call NVC if they say they mailed it.

Do come back keep us posted. This does happen now and then. Its no big thing and no delay.

There is no need to cry. Everything is fine.

They just clicked a button that made that message appear. It is a pre-written message that someone included in your notice. I have seen this message get mistakenly put on notices before. It's nothing to worry about.

Just follow up that your petition is going to NVC and don't cry. Really :)

I received the same mistaken message in my notice of approval. Completely freaked me out as I was not in the USA at the time. You need to call USCIS and request to speak to a Tier 2 supervisor. Don't even talk about it with the representative that answers, they don't know and will give you wrong info.

Ask the supervisor where your case is. Did they send it to the NVC? What date did it leave the building for NVC? If they didn't send it you need to put in a service request to have it sent. Tell them that your husband has never been to the USA and he is not there now.

If they confirm to you that it is on it's way to NVC or already left for NVC, call NVC and make sure they have your file.

Same thing happened to me when we got approved. Called and talked to a rep, not level 2, and opened a service request. Everything got sorted out within a week or so.

Don't worry, just call...the best thing you can do is to stay calm and explain calmly what the problem is (and likely just an error...they make mistakes too). They'll figure it out! Stay strong!
