RFE NEED QUICK RELIABLE HELP PLEASE!!!!!!!!!

Got an rfe for not sending in the entire divorce decree, I just originally sent in only the page the judge signed. I just sent the rfe but after I sent it noticed 1 page that has absolutely nothing to do with anything was missing and I failed to send it. All other 25 pages are there including the certified page and the judges signature. They just received it today in California, should I send them another complete divorce decree or just wait and see what happens? I have heard you only get one chance at responding to an rfe, Iam very scared now and don't know how strict they will be over one page missing out of 26. I have another certified copy of the divorce decree ready to go.......Please what should I do.....Thanks.......

What is the exact language of the RFE letter? Hopefully you will be okay. Like so much in these processes, a lot depends on the adjudicator.

It sound like you did what I did, I originally had sent in signed divorce court documents. In anticipation of a RFE with my initial I-129F petition, I requested from State Vital Records Dept. a copy of the Decree of Divorce Record. Here is the link for Oregon: http://public.health.oregon.gov/BirthDeathCertificates/GetVitalRecords/Pages/index.aspx. Other states and counties likely have a similar process. I would suggest that you get a couple copies. Luckily the initial petition adjudicator accepted my signed court documents. However, at the visa interview and the subsequent AOS interview, I was asked to show my divorce records. The State Vital Records Divorce Decree were accepted with no problem.

there was no answer to my question there, if i screw up the rfe they ask for, will they give me another chance to fix that same rfe, its just one page missing from the divorce decree that i forgot. thanks

They may not even notice the one page is missing. They could send another RFE, or could just deny for not satisfying the RFE. I am going to vote for approval because you sent in a 25 page decree that included the certified page with judge's signature, so not sure they would catch that there is a single page missing.

Suggest sending the US government a single page copy of a certified divorce certificate rather than an entire divorce decree. A divorce decree contains additional information relating to the divorce that they are not entitled to ask for unless the petitioner decides to send it upon their own personal choice. Most states provide copies of divorce certificates which are available from the bureau of vital statistics for a small fee.

Divorce Certificate
A divorce certificate usually names both spouses, as well as the date and place the divorce was granted -- but typically no other information. Divorce certificates serve as proof the couple is no longer married. State laws vary with regard to who, other than the spouses involved or their attorneys, is allowed to get a copy of a divorce certificate. A divorced person may use a certificate as evidence of the divorce for various legal purposes. For example, a divorced person may need a certificate for the state motor vehicle department if she wants to change her married name on her license.
Divorce Decree
A divorce decree has the same information the divorce certificate does and summarized information from the divorce judgment. This document is signed by the judge and part of the divorce case file. Decrees also state the basic facts of the divorce and the court case number. For example, if one spouse was awarded spousal support, the decree will state which spouse pays and how much. All the terms of the divorce, such as child custody and property division, are outlined in the decree, as well as other issues the parties agreed on or the judge decided. Only one of the spouses involved or their attorney may request a decree copy in most cases. A divorced person may need the decree to check the divorce terms or to file an action in court that relates to the decree, such as a petition for modification of the original spousal support amount.

A K1 petitioner must prove that they are single and free to marry. You have the option of sending a complete divorce decree that includes every single page. If you leave out one single page you will get an RFE. Or, you can order a single page copy of a Divorce Certificate from the Bureau of Vital Statistics from the state where the divorce was terminated. My suggestion was the latter.

You have two options.

1. Send a complete copy of the divorce decree that includes all pages making sure that every single page is included.

OR

2. Order a copy of the divorce certificate from the bureau of vital statistics in your state.

It's your choice. Again, you only need to prove that you are single and free to marry. If you do not respond to the RFE then you will be denied.

since you have already responded to the rfe, there is no guarantee that anything you send in now will be matched up with your case file. as jay-kay said, there are three possible outcomes:

1. they notice the missing page and send out another rfe

2. they notice the missing page and deny the petition

3. they don't notice the missing page and approve the petition

any one of the three could happen, depending on how lenient/detailed the adjudicator is. you can certainly try mailing in the complete set now, but again, there is no guarantee that it will be seen by the guy looking over your rfe.

Pleaseeeeeeeeeeeeee listen to me, your not responding to what iam saying........i sent in the entire decree on friday..........they now have it in their hands..........minus one page out of 26...........this was my response to the original RFE........will they give me the chance to provide that one missing page or deny my application???????? thank you ......

ive read here before NEVER send in more stuff, it will only cause problems.......thank you, i guess it is what it is

This is the answer to your question, OP. It is NOT possible for anyone here to tell you exactly what will happen because of that missing page. There have been cases were there was a flat out response after the RFE as sent, either denial or approval, and there have been cases where a second RFE was sent. No one here will be able to tell you how your specific situation will play out, because no one here can guess what will go through the adjudicator's mind when reviewing your REF reply. You really have little options but to wait to see what happens.

There is the option of re-sending the RFE reply, but as has been stated, there is a possibility that your re-reply will NOT be matched to your case. As such, most members suggest that sending unsolicited information is not a good idea. Again, no guarantees.
