filled k-1 with different fiance

Hi all,

I will begin filling for my K-1 visa in august after my second visit to vietnam so I want to be prepared for potential red flags one of them having filed for a K-1 previously (4 1/2 years ago) with my previous fiance had been approved to come to US with her family and no longer needed the K-1 I filed. I was told I need to address this and to let them know about my previous file but im scared that this will bring up a big red flag. Needless to say we were together for 3 years but ended up breaking up becuase of family fighting. Please le me know if I should frontload and explain the whole story or not explain anything at all, We never married and she never went to the interview for K-1.

-I dont want them to think its not bonafied having abandoned the K-1 application

-I waited a year after we broke up before meeting my new fiance online. (yes its kinda fast)

What is the status of the 1st K1? Was it approved or did you have to withdraw it?

You do have to be truthful about your previous application when you prepare for the second K1. In addition to that, you might need to file a waiver and include it in your packet. There is no set format for the waiver, it will just have to include a statement that you filed a previous K1 for a different fiancé and an explanation on why it did not work out. Be prepared to explain everything. It is not necessarily a red flag but situations like this (while it does happen) can cause your IO to look at your case more closely. Good luck!

I believe the application was approved she had an interview date but did not attend opting to go to her family interview instead and got approved with them she was 21 or 22 at the time but by a stroke of luck was able to get approved with the family. Ill have to look into filing a waiver and including it in the i-129f package explaining why it didnt work out.

nov 3rd 2013 is when i sent the withdrawal letter stating that i officially withdraw any pettition for previous I-129f and sent it off. untill this day I have not heard of anything as of yet so im assuming everything is ok.
