Hello members! I have few questions:

1. My marriage did not work out and my husband found someone else. I'm gonna be sending papers in june (5 years residency) my question - do they concentrate on the marriage or the officer don't care about it, since we already divorced and proved that we had a real marriage. I know that I have to send the prove of divorce but other than that???

2. I am 5 month pregnant, but its only my child (my ex is not interested) so will they ask any paperwork for this baby, since my due date might be after the interview?

1. You need to show a bona fide marriage. Proof of a life together - bank documents, bills, etc.

2. The baby is not only your child. Under US laws, he is the father whether he wants to be or not. He can sue for custody even if you don't name him on the birth certificate. You can sue him for child support.

I think it would be a bigger deal if you were applying on 3 year rule (married to US citizen who brought you over the US), but you're not. So you should be fine.

Your first answer is completely wrong. Under the five-year statute which the Original Poster is applying, nshe is exempt from ths burden EXCEPT if the Immigration Officer, applying broad discretion, requests this documentation. Unless other factors are involved, this alone will not ultimately materially impact the petition.

Your second question is not a custody one, but a documentation one. Your pregnancy might anecdotally surface during your intterview if you are showing, but you cannot, neither can you be expected, to provide documentation for such an unborn baby which is not even recognised at this point as a person for matters of legal concern (except in cases of illegal abortions, other willful harm to a fetus, etcetera...but that's straying from the question at hand)

1) You shouldn't have no problem applying for your N400 process even after divorce. Applying under 5 year rule you don't have to have a lot of evidence to prove any kind of marriage. However depending on your officer, he might ask you about. How did you meet? where you lived? why did you divorce? Don't feel kind of offended if you felt he/she was being harsh. You have to remember that they are trying to do their job to prevent fraud. (Im not saying you are, but there were cases that unfortunately was similar to your situation).

2) Whether he wants to be involved or not that kid is his. (i'm not forcing my opinion), but by DNA he is the father. You wouldn't have the kid without him. You have the option to raise your kid by yourself but not to say who is the father. I don't think that you will be asked about any paperwork since you will deliver your baby after your interview. He/she MIGHT ask you if the baby was from your husband (Sorry if I embarrassed you, but the oficer might want to understand your situation).

I'm sorry for my honesty but I hate men who get a woman pregnant and then they say I don't want nothing to do with the baby. Those are not men, those are immature people who need to grow up and be responsible.
