I submitted the I-751 to remove conditions on residency in Feb. 2013. I recived notice in March saying they received my documents and I recieved another letter from them later in March for my biometrics appoitment. I went to my biometrics appointment like required. My case was with the Vermont Service Center. I waited 5 months after I submitted my case and then I started calling to check on my case stauts. I never heard from them. In January I submit an inquiry and I received a letter a few weeks later saying my case was still under review. In March 2014 I went to the Atlanta, GA office and they told me my case was denied in December. This made no sense since every time I check my status online (even today) it says it is still under review. How was it denied in December 2013 but according to the letter a month later it is still under review? They claim they sent request for more evidence in Aug. 2013, but I never received any letter from them in Aug.

Has anyone else not received a letter they claim they sent? Has anyone else been denied due to "abandonment"? It has been over 4 months going on 5 months since I was deined and I have not received any letter indicating when I need to leave the country or what steps to take. If I did not receive there letter in Aug. and Dec. I am afraid I will not get other important documents telling me what to do. Does anyone know how long I have before I am deported and what steps I should take to refile? I have called the USCIS many times and they are never helpful. They even told me my case was under review after the time it was denied in December. They have no records now of me ever calling and I cannot get my phone records to prove to them I did call them many times.

Has anyone else faced a similar situation? Any suggestions or advice will be greatly appreciated. Thank you!

Plenty of people haven't received letters USCIS has claimed they sent. Plenty of people have been denied for abandoning their applications by not responding to an RFE as well. You will likely be placed in removal proceedings if you do nothing, so do not do nothing.

1) Contact one of your congressional representatives, outline the situation, and ask what they can do to help.

2) Contact the DHS Ombudsman and do the same: http://www.dhs.gov/case-assistance

3) Speak to one or more experienced immigration attorneys to see what can be done.

follow what hypons told you and keep all the correspondent with uscis, to show it as proof. I think you will have to file a motion to reopen, seek experienced immigration attorneys and seek help from the ombudsman and congressman simultaneously. let them know that uscis process is broken somewhere

I agree with above posts, it does happen regularly where people get denied because of some mix up not of their fault, most likely you will have to appeal and then refile, I suggest hiring a lawyer immediately.

For us calling the USCIS, contacting our immigration attorney, ombudsman, and even our congressman was worthless. Only our senator has an immigration office to assist us. Fortunately our senator was Feigngold that headed the USCIS finance committee. But I needed my wife's permission to act on her behalf.

Turns out with all the BS we received, ironic the number of USCIS employees were also immigrants that became US citizens to get these jobs, Our application was sent to the wrong service center. With Feingold's girl working for us, they found it in a darn hurry. And sent it overnight from Nebraska to the California service center. With long delays by these guys, still requested an RFE, namely up to date tax returns and bank account statements.

We had to make an infopass appointment with a 450 mile extra job to get an I-551 stamp in her current foreign passport book. With Feigngold batting for us, this was not a problem. She finally received her ten year card, after her citizenship interview. But this wasn't bad enough, some idiot at the St. Paul office misplaced her application, never received an oath letter. Another call to Feingold's office, found that in a hurry. This was on a Friday, and they made a special appointment for her oath ceremony on the following Tuesday for a brief oath ceremony. But we had to be there at 8:00 AM in the morning.

Wish I was making up all this stuff. But this was our experience. Contact your senators office, you have two of them, hopefully one of them has a good immigration office.

I was always a fan of good old Russ Feingold. Too bad he isn't around anymore. :(

The only one that voted against that American Patriot Act, because he was the only one that read it. We also ran into problems with my stepdaughter, USCIS wanted her to explain assault and battery charges when she was 17 months old living in Venezuela. That Senator Johnson was not even around, when elected, took a vacation. Was a good thing that Senator Kohl's daughter took and interest in her, or will still would be waiting.

Key reason why I mentioned having two senators to deal with. I knew Obey for years, told me, they don't have anything to do with immigration. Honest guy, spend one year in congress the other trying to get reelected.

I have a friend that is facing deportation. Even when placed on deportation, that process in itself can take years. So it is not like you are required to leave next month. There are many court sessions and it is really up to the judge.

This happens quite a bit. For example,my cousin AOS was initially denied because USCIS claimed that they had not received the RFE documents on time. Fortunately, she had requested for tracking information when she mailed these. So she provided this to them and they took their denial back.

I'd tell you to contact an immigration lawyer.

I know I did not help much. But I atleast wanted to give you some encouragement. I would be trembling right now if I was denied even though it is not your fault. So I can only imagine what you are going through.

Keep your head up. Weigh your options and remember that while this feels like the end, it is not. I like the idea of contacting your congress person though. But talk to an attorney asap. Hang in there :)
