VWP/Tourist visa is dead as soon as the K-1 is issued.

Why would the VWP be dead, the issue here is not the VWP but he wants to immigrate with it.

If they leave before AOS, it is not necessary that VWP (or ESTA auth) is dead... You can be married and enter under VWP, but you cannot enter on VWP with the INTENT to stay and adjust status... So if they leave, they cannot re-enter with immigrant intent (on the dead k1), it is possible they COULD be admitted as a tourist on VWP (which would subject them to the 90 visit, not work limitations of the program) but the also could be denied entry if they do notmshow enough toes to leave the usa... but they would have to leave before the expiration of the VWP authorized period of stay ... Meanwhile, they would have to file the CR1 spousal visa paperwork and interview in the home country (10-15 months process) ...
