So, my once fiancee is now my wife. We got married at the city clerk's office yesterday in NYC (we plan on doing something bigger with family involved in Oct.) and I just wanted to thank everyone here for all of their assistance with forms and possibly crazy questions I may have asked.

My question now is: We had a deadline to get married (as she only had 3 months after entering the USA with her K-1 Visa) and we had a deadline to get married after getting the marriage license (we had 2 months). Of course I want her to get her green/work/travel card and all of that as soon as possible, but is there any other deadline I need to worry about for the time being? I mean, can I take a break from worrying about this for 1-2 weeks?

Background info. I am a US Citizen and she is a Japanese Citizen who is now officially my wife.

P.S.- I will research this and all of my other queries on this site more extensively soon. but I just want help with this quick question. Thanks.

I think you should be fine to take a break and relax for 1-2 weeks :)

You got SSN (unless you have it already), and AOS and adding her to your health insurance/DL and all that to worry about but I am pretty sure it can wait for that long.

Congratulations on your wedding and don't stress too much. I know I did and it sure did not make things any faster or easier !

Timeline

There is no deadline to file for AOS as long as you married within 90 days of entry. However, once the I-94 is expired, your wife will be out of status until she files for AOS which will place her in a new period of authorized stay.

Apply for her SSN ASAP or you will have to wait until her AOS is approved for her to get one. If you apply too close to her I-94 expiring, they may make her wait. Her I-94 may be stapled in her passport, unless she has an electronic one. She would have received it at POE.

She is a Japanese national who applied for the K1 Visa and had 3 months upon entering the country to get married. What is the best source to talk about this? Anyone have a specific number to call? Should I seek help from which side?

Jay-Kay, I will try that link and input her info. and see if anything pops up. What should I do if it doesn't?

When did your wife come to US? I assume she came to US for a while now.

The I-94 is electronic so you can get it from the link that Jay gave you. Some people says you can obtain I-94 after 2 weeks of her arrival, but it is really fast now and you dont have to wait for it. My wife came to US on Saturday and I was able to get her I-94 on the next day.

Make sure you type in the right information on that website. If everything is corrected, but nothing comes up then you can try different combinations of her name. For example: I entered my wife's Given name as First Name then Middle name, the website say no data was found. Then I tried it with Middle Name then First Name, this time was working.

CBP could be entered last name as first name, who knows. Just try it and let us know.

If you try everything out and still nothing comes up ( assume she came to US more than 2 weeks), then you need to contact CBP to figure out. You need I-94 for AOS, SSN, and Driver License or ID.

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

There should be a number written in side her passport. Enter that number on the link JK sent you.

Regardless, the I-94 expires 90 days after entry to the US. At that time she will be considered out of status. The is no requirement to file AOS before the I-94 expires, but best to do it anyway. You don;t really want to accumulate overstay.

She should keep a copy of the printed I-94 with her at all times. In the unlikely event she is asked to produce immigration status the I-94 indicates she is here legally.

Friend of my wife was involved in a minor traffic incident. The officer asked to see her I-94. Not sure if that request was legal, but he asked for it all the same.

They are not paper forms that are stapled into the passport when entering by air. They are automatic and electronic, that is why you need to go to that site to retrieve your I-94 info. Print out your I-94 info and use it for the SSN and AOS.

So, I've read your suggestions and information and I def. appreciate that, but I won't be able to get the AOS and/or Social Security # before the I-94 "Admit Until Date" which happens to be April 25 2014.

What should I do as she'll technically be "out of status" or whatever you guys refer to it as? Should I just try to do the AOS as soon as possible and not even worry about the Social Security Number now (I mean, I planned on calling them on Monday anyway to get their advice)?

What do you guys suggest?

I never knew that we had to get the SSN with the I-94 number, because I never knew that my wife was given one upon entering the USA.

If her 90 days is 4/25, then she might not be able applying SSN. She can come back to apply when she has EAD/AP card.

There is no dealine to apply AOS, but she might get detained if she is out of status. I recommend you to apply AOS as soon as possible , and there is no required for SSN to apply.

Yes, apply as soon as possible. When she gets the EAD/AP, then use that to get her SSN. Stay away from border check points or riding on buses while she is out of status. Once you file for AOS, she will be in a new period of authorized stay.
