Hello,

I have been reading many threads on Visa Journey which have been very helpful so far.
I am a French Israeli dual citizen and my fiancé is American Israeli. He was born and raised and NY and moved to Israel 5 years ago. We both live together in Israel and are filling for a K1 Visa from Israel to move to the US next year.
We just received NOA 2 and are starting to gather documents.
I have a couple questions regarding the Affidavit of Support as I am not sure to whether we meet the requirements or not.
My fiancé worked for 7 months in 2013 earning $12,000 total during that period. He received severance pay and unemployment for 3 months after that since he had been working at his company for over two and a half years. He found a new job this January and his income is about $1,700 / month. His savings amount to $20,000 here in Israel and he has a couple extra thousands back in the US.
As for me, I am not sure if that is relevant at all, I am a graduate student with a part time job where I make $2,000 per month and I own an apartment in Israel with a value of $200,000. I don't have much savings.
I see online that he is supposed to be earning 125% over the poverty line for a household of 2. I read on this forum that they usually look at the current income and calculate the yearly income based on that.
Do we have anything to worry about? Am I actually allowed to add proof of what I am earning to the packet ?
We thought about asking one of his parent for an Affidavit of Support but are not very comfortable with the idea as I will only be meeting them for the first time next month.
Many thanks for any help and input.

$1700 a month is $20,400 and meets the income requirement for a household of 2. He will provide his most recent tax transcript, letter from employer and/or most recent pa stubs. If he goes ahead and lists his $20k in assets, then he needs to show bank statements to prove those as well. Your assets do not count for the I-134.

Hi Jay Kay,

Thank you for your answer. The thing is that his 2013 tax return is only for 12,000$ as he only worked half of the year. Is it what would be taken into account or his actual salary equalized to one year ?

I am sorry I am just worried that we would be turned off because of the financial requirements.

Thank you

List the current annual income. Hourly pay times hours worked per week, then multiplied by 52 weeks to get his annual gross income. The letter from employer and/or recent pay stubs prove that income amount.

Hey Celine,

I think you need to do a bit more research, I am not sure he will be able to list the money he is earning in Israel as the money for the affidavit of support, I think you both probably need a cosponsor who has an American income. Also from what I've read so far on this forum his saving would need to be in his U.S. account and to use savings alone it would need to be closer to $60,000. I am also interested to know the proper answers to your questions so let me know if you find out for sure. Thanks!

Wow, I completely missed the fact that the income is not US based and would not be continuing after moving to the US. Thank you for catching and correcting that. OP would need at least $60k in assets or permanent, ongoing income in the US that meets the requirement. Otherwise, a co-sponsor will be needed.
