unemployed trying to apply for AOS

Please fellow VJ my friend is trying to apply for AOS through marriage but his wife doesn't work and she hasn't filled for Taxi for the past 3 years cuz she didn't have a steady job. so how would she go about the i-864 form does she has to show any prove of non filling or any document that she doesn't work. they do have a sponsor who is make enough money and will to sponsor them

04/01/14 Sent AOS I-485 + I-130 + I-765 (day 1)

04/03/14 Package delivered at Chicago office (day 3)

04/09/14 Received 3 emails. Status: Accpt for I-485, Initial Review for I-130+I-765(day 9)

04/16/14 Hard Copies of NOA received + Biometric Appointment Letter for 05/07/14(16)

04/28/14 Successful walk-in for Biometrics Appointment jamaica Ave (28)

05/06/14 Notifications via text & e-mail: i-485 updated to "Testing and Interview (36)

Even if she didn't have a steady job, unless she made under a certain amount, she would still be required to file. She would have to do 3 years of back taxes before they could proceed with AOS, even with a co-sponsor because she would be considered the primary sponsor regardless of her income.

However, if she made under a certain amount (you'd have to look what the minimum annual amounts were for the last 3 years) then she'd have to write a letter explaining why she didn't file taxes along with proof of her income to show it fell below the required amount to file.

She would need a write a letter explaining that she was a stay at home mom with no income and that therefore she was not required to file. She still has to fill out an I-864 because even with no income, she is still considered your primary sponsor. Then your co-sponsor will fill out an I-864 or an I-864A depending on if they reside in your same household or not.
