We are on k1 process and we are waiting for noa2.

Since august i came back from my fiance i live with my mother cause i dont work anymore and i cant have my own.

My question is....

Can i use esta and go live for a month two or three(esta allows me 3 months) with my fiance?

Things here at the house with my mother and her husband are really bad i really can stay longer with them. I prefer to live on the streets than live more with them.

Will i be able to go and tell the truth to the officers that i wont overstay or get married cause we are already on the k1 process and that in case we get noa2 i ll go back to take care my medical exams and have the interview.

I have no other evidence to prove them that i ll go back. Only the noa1 and the case number. I have no an apartment on my own even money on the bank or bills!! I dont want to go and spent money and then not let me go and send me back.l :( that will kill me....

I spent June-July in the US on the VWP while waiting for my NOA2 with no issues. I actually received my NOA2 while on holiday there! In most cases it's perfectly fine but it is a good idea to bring proof of ties back to your home country. The pending K-1 & taking your NOA1 with you may help but I would recommend trying to find more. Good luck!

An you may VISIT the USA not LIVE there... Symantics however the us govt is afraid you will go and live there and not return, so I would use the word visit so,there is not confusion. I would bring more documentation of you have it.. Hopefully with VWP you will be just waived through...

I just did that. I visited my fiance Dec 28th till March 27th and had no trouble getting in with ESTA. They asked me where I was staying and I said with my fiance. Then they said that it was illegal to get married while I was there as a tourist. I told them I knew and that we had filed for a K1 visa. I had brought my bank information, lease agreement and proof that I owned a car in home country but they didn't want to see any of this....so no problems at all. Just be honest and don't make up any werid story where you'll be staying and all that....GOOD LUCK :)

You will be a tourist when you are there and must comply with all rules of your tourist visa or VWP as the case may be, including no work or business and leave when you are required to leave.
