Hi Everyone,

i want to ask anybody who knows the answer to my question.

We filed for my son's I-130 ( it was actually my USC husband who did the petition) . Anyway, we are still waiting for the case number from the NVC. However, my mom, who is the guardian of my kids this time in the Philippines just recently told me that my son doesn't want to migrate here i the US. He like to finish college there. Prior to filing the I-130, I personally asked my son if he is really to stay here in the US already, and he was ok with it. And then came the conversation about the medical ( I think he got afraid knowing that he will undergo blood test, Skin test since he is minor, and few immunization ) just lately, I sensed that he seemed to be afraid or worried about that. Also, about him getting a degree, I told him that college is really expensive here and people here sometimes work and attend school same time. So, I am no sure if that scared him too.

my question is ( in 2 scenarios ):

1. if ever my son really is not yet ready to be here, can we extend the I-130 or freeze it and use it later on when he is ready? ( I need to again make a heart to heart talk with him but I like to be ready just incase he change his mind )

2. If incase he is done with his medical and interview at the embassy and get approve and then again will tell us he is not ready to be here, is there anyway for us to extend his visa? If possible:

a. how long can the visa be extended?

b. what must be done to extend the visa?

You can't freeze the process - He is a minor and also a Filipino beneficiary, so the process will move quickly as all Filipino's are expedited right now automatically. He needs to make the decision if he wants to move and quickly too if you are already at the NVC.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Im not so sure but i think you can somehow "freeze" or slowdown the process once you reach the nvc stage since you have the control on when to pay the fees and submit the documents. When we received an email from nvc stating that our case is now rady to be processed, there's this part that says:

"One-year contact requirement

After you receive notification that the NVC is processing your case, you must contact them at least once a year. If you do not contact the NVC for one year, all documents and fees on your case will expire and you must resubmit them to resume processing."

So i guess you can slow down the processing at nvc while your son is still trying to make his final decision.

11.18.2013 - requested expedite due to typhoon

12.02.2013 - CFO seminar

12.12.2013 - I-130 approved, NOA2 via email (never transferred); shipped to NVC

12.30.2013 - NVC received the case

01.06.2014 - requested expedite due to typhoon and PCS

01.08.2014 - Case # and IIN; submitted DS-261; NVC asked for 2 contact #s of beneficiary

01.09.2014 - AOS fee billed

01.14.2014 - AOS fee showed paid

01.15.2014 - IV fee billed; expedite approved

01.18.2014 - sent AOS package

01.22.2014 - IV fee showed paid; AOS arrived at NVC as per UPS (10:18am by FNU)

01.24.2014 - sent IV package

01.27.2014 - submitted DS-260; IV docs delivered to NVC as per DHL (10:52am by PETERS G)

01.29.2014 - CASE COMPLETE (via phonecall)

01.30.2014 - received checklist for Dutch Police Record (VOG) via email

01.31.2014 - left NVC, sent to embassy

02.04.2014 - received at embassy, READY as per CEAC

02.10-11.2014 - medical done, passed!

02.24.2014 - interview: APPROVED!!

02.27.2014 - Received SMS from 2Go, ready for pick up

02.28.2014 - visa on hand; CFO sticker

03.01.2014 - paid ELIS

03.06.2014 - POE Hawaii...Aloooohaaa! :)

04.10.2014 - 2yr green card received

Ones the interview is done and is approved, how long should the beneficiary ( latest period of time ) enter the US before the visa expire? .

It depends on the validity of the medical results (which is usually 6months). Like for mine i had my medical on feb10 this year, interview feb24, my visa is valid until aug10,2014. So i could choose to fly to the US on aug9 if i wanted to.
