Hi there,

I (the petitioner) am a full-time student working part-time, so I only made roughly $10,000 last year. My dad is our joint sponsor and he filed taxes jointly with my mom. I'm trying to figure out how we go about filling out these papers, but from what I gathered, I will fill out an I-864, my dad will also fill out an I-864, and my mom will fill out an I-864A?

The part I'm confused on is household size. Do my dad and I both claim my (immigrant) husband under the household size on each of our I-864's? (I know the paper says "DO NOT COUNT ANYONE TWICE, but took that as don't count any person twice on the same paper i.e. my husband as the "immigrant", then again as my "spouse".) I just don't want any issues when I send this out.

Thanks for reading.

:-)

Your husband will count as a household member for both you and your father. So your household will be 2 and your father;s household number will be everyone he claims as dependant on his taxes.

Also, if your father's income is enough for his household members according to the poverty guidelines, your mom will not need to fill out I-864a. If its not enough, then their combine income should be used and she will fill out the form.

And total income = your income + your Dad's income. Household size = You (1) + your husband (1)+ your parents(2) + any dependent if applicable. If your Dad dont have any dependent, so your household size = 4. If your income+ his income meet requirement of poverty guideline, your Mom doesnt need to file I-864A.

Remember, if you and your parents living in the same house. Your Dad needs to file I-864A instead of I-864

Ok, great. Also, I live alone, not with my dad. So I-864 it is. Together we have enough, so my mom will not need I-864A.

Thanks, you guys have been so helpful :)
