Divorce Paper - Do they need to be notarized/translated?

Hello!

I am a US citizen filing in the US for my fiance in Cuba. Do I need to notarize my divorce settlement that I will be sending with my I-129F? Do I need to notarize and translate it into Spanish for his copy of my I-129F packet? If in doubt is it just best to notarize because that is the only thing on VJ that seems to have mixed comments. Any help/suggestions would be gretaly appreciated

The divorce decree does not need to be notarized and it needs to be in English.

His copy of the I-129F packet is for his reference only, it is not needed for the embassy. The embassy will receive the complete approved petition from the NVC.

It needs to be a stamped certified decree obtained from the county clerk where the divorce was filed. Full copy in English.

How would you get a notarized divorce decree ? It's already been signed by the Judge, who is most certainly not going to sign it again in the presence of a notary.

A certified copy perhaps ... available from the Court with the proper seal stamped/embossed on it.

You do not need to translate anything into Spanish. The I-129F is only for US authorities and so you only need to submit the paperwork in English.

I have another question. Do I need to include details of my first husband in the letter to support of relationship if it overlaps with my fiance?

August '10 met fiance in Cuba and became friends - I was legally married

Janaury '11 separated from my husband

May '11 started relationship with my fiance

August '11 legally divorced

Since I need to include my divorce decree I want to cover all areas of information to avoide an RFE.

I didn't, and I didn't get an RFE for it, but I believe Cuba is a high-fraud country where sometimes it is best to front-load the petition.

You don't need it for the petition approval, so I would look into reviews of the Embassy he'll be interviewing at and see if it will be important or not.

I have a question in connection to the thread.. What if my fiancee was divorced and I only have a copy of his divorce papers? It is a photo copy he made for me to bring back to the states for when I file. Do I need his original copy?

I understand that it will need to be translated into english and notarized when done. Would this be enough or again do I need his original copies?

I also thought that you are not suppose to send in anything original?? Only take them to the interview?? The only original thing that should be send it are papers he would need to sign like the biometrics and any letters he has hand written?

You have to send original certied divorce paper and if his is in spanish it needs to be translated as well as an original birth certificate translated also. I to had the problem about being married at the time of meeting my fiance here is my time line

First trip to cuba July 2010

Met fiance on march 2011 he is a family friend

Got together October 12 we were both seperated at the time

July 6 2012 he proposed

July 26 2013 i got my divorce finalized.

And yes they will question you on that they did to me when i went for my interview maybe that is why we were put in AP. Although on my written statment i explained everything. Just make sure you write dates for when you got together and when you were seperated. They will ask you at the interview

sucks because I don't have his originals and that means I will have to go back to cuba to get them since there is no way to mail things.. ughh this whole process is tiresome and I haven't even started. I get stressed out listening to everyone elses stories.

I should have just taken all his documents when I was there he already had 2 of everything. bummer

Pepper44 - The birth certificate needed for the I-129F is for you. You will need an english translation of your fiances birth certificate when you have your interview in the US.

There is an interview in the US after he gets here? I never knew that.. lol well that will solve the birth certificate problem but not the divorce docs. Thanks for the info much appreciated!

I sent my husbands divorce decree and it is just a photocopy. No need to be certified copy or notarized copy

Heed my words, in the county you got your divorce, you can get a "certified" copy with a red stamp on the front pagem and will pass any tests that might me met, along the way, might cost you $2.00.,.,.,I would get two extras, as if you are K-1, you will have to do the AOS.

And just for info. to avoid many problems, for Filipinos absolutely, do the "Report of Marriage" ROM, to the Filipino embassy in Wash. D. C,..,as I had to do this, ($25.00) just to get my wife's passport renewed.
