Adjustment of Status, annual income question

Hi Vjers,

Am about to file my AOS later today.. am still undecided on what to put under current annual income.. since i've done my 2013 taxes, do i put that amount as my annual income?? or the amount written on my employment letter as Base Annual Salary (not including differentials, etc).. But it's $25k less compared to my 2013 taxes annual income..

Put what is written on your employment letter. Include at least two to three months pay stubs to proof it!!! Hope this helps. Also, how much do you make an hour and are you working full time as well?

Yes, am full-time.. I got 2 jobs.. One full-time which has my base annual income (without differentials, overtime pay, etc) of > $59k based on my employment letter.. 2nd job is PRN/as needed, which is really hard to project annual income coz it depends if I work or not, so HR didn't write any annual income on my employment letter, just my rate per hour.. but with these 2, I made like $89k this 2013 ITR.. so am confused which one to use.. :wacko:

Oh OK!!! You can used the job with 59k. What is your family size? If you can use job one to meet the income requirement, there is no need to include job two. Just include pay stubs and employment letter from job one. If job one meets the income requirement then you should be good

I would put for current employment, base salary + bonus.

You have to be able to prove hat income you currently have, and bonuses are not guaranteed and not provable. Put the base salary, and if it feels weird, just add "+ bonus" to your figure to explain the additions on last year's taxes.

That way you have the Form(s) W-2, 1099, interest income/capital gains statements, etc, to substantiate that figure.

Thanks for the immediate reply! $89K is the adjusted gross income/total income on my 1040, if from wages,salaries,tips, it was $79K only; the other $10k was from my 401K that I got when my resigned from my previous job.. Is it safe to write $89K still? I got W2, 6 months paystubs and 1099-R form..

thanks! the only reason why am doubting putting my base income from my employment letter is because it's way too low compared to my past years income.. well, probably because it's only coming from my full-time job, but the employment letter and stubs would be the only proof of that.. my other PRN job is not included there yet, since they can't project how much I really make every year since it depends, thus making it only 59k.. With the ITR amount, I made 89k, since full-time and PRN job is already included.. I don't want them to think that my income fluctuates, you know.. coz if I compare it to my 2012 and 2011 ITR, 59k is way different from 90k.. what do u think?

You exceed the income requirement for the family size of two if you use only job one income. You will be more than OK if you use job one income because you have sufficient income to support the immigrant.
