Hello everyone ,

I I would like to petition for my dad and stepmom to come to America . Also, my 8 years old half brother . Can all they come to America as the same time ? I heard that you have to petition for your dad first then when he enter United States he can immediately filed period for his wife and son.

at what age did your dad marry your stepmom? if it was after 17 you cannot file for her. also your stepbrother cannot come with them, there are no derivatives on parents petitions

that's why many times you petition one of the parents, such as your dad, then when he comes, he can file for his family

even if you can file for both of your parents, will they leave your stepbrother behind?

They are married on February 2007. I was 17 at the time but I live in the states when they are marriage

You can petition dad. 1 year for visa.

You can petition stepmother since you were under age 18 when she married your father. 1 year for visa.

You can petition brother. 12 years for visa.

When a US citizen petitions a parent or stepparent, only that person gets a visa. Children cannot get visas. So your brother can not immigrate with your father or stepmother when you petition them.

Here is the plan.

Petition your father. He comes by himself. He gets a green card. He files for his wife. Your brother would be included as a derivative beneficiary. 2-3 years for visas. His wife and son immigrates together.
