Let me start off that we're excited and about ready to file both our packets! the I-130 and the I-485.

While proof reading everything I came over a confusing part of the I864.

Since my husband just started up his business in a new location, we've had a lot of expenses and not a whole lot of income. So he made the requested amount last year, but not the two following years. With that, his parents volunteered to sponsor me while the whole process goes through.

Now, for part 5, line 8 it asks to tally up the number from line 1-7 this adds up to 3. Myself, his mother, and father. But in bold on line eight it asks for household size, I put 2 (his mother and father), since we don't live with his parents.

Would 2 be correct? or have I made a mistake?

I would read over it again girl. I have read the form, but that does not sound correct.

Under Section 5:

You would have a "1" under number 1 - which is your beneficiary

You would have a "1" under number 2 - which is you.

If you LIVE with your parents then you would have a "2" under number 7.

But you do not Live with your parents, so your total under number 8 would be - 2

A lot of folks on here are much more the expert then me, but from what I've read this looks pretty good.

Oh dear, I'm a whole lot more confused now. I thought I was doing this correctly.

The sponsor is my husbands father (my husband does not meet the requirements), he's writing out the I-864 (I'm not sure what I need the I-134, since the guide didn't call for it.)

Under Part 5.

1. Enter the number you entered in line 7 part : 1 (me the principal immigrant)

2. Yourself: 1 (the sponsor, my father in law)

3. If you are currently married, enter "1" for your spouse: 1 (His wife, my mother in law)

...

8. Add together lines 1-7 and enter the number here. Household Size:

As I'm not part of the sponsors household I would exclude myself (line 1), and tally up line 2-3 Himself and his wife. it would tally up to 2?

Or do I disregard the bold Household Size at tally 3?

My thought is they're asking for the number of people in the sponsors home. So that's why I put 2.

Disregard the advice for the I134, that isn't needed here.

Your husband needs to complete an I864 as he is the primary sponsor regardless of whether he earns enough, then your father in law would fill out a second I864 and his wife would fill out an I864A.

This is for an I-864, not an I-134. Also, you are completely incorrect about how household size is counted. Please read the I-864 instructions. It will explain it to you.

Pay no attention to the misinformation you were given. Everyone you live with is not necessarily in your household count.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ

If it is just you and your husband, then your household count is 2: 1 for you, the intending immigrant and 1 for your husband, the USC petitioner/sponsor.

For the joint sponsor, they will put 1 for you, the intending immigrant, 1 for himself, 1 for his wife and then however many more dictated by their dependents. If they have no other dependents, then their count is 3. Have his wife list her income on his I-864 and fill out an I-864A to go along with his I-864.

Thank you all for correcting me, perhaps I read the question wrong..................MDaffron, I'm sorry.

Hopefully the experts will take over, my experience was from what I just did for my spouse.

Thank you I fully understand................ I don't need a sponsor, and am not at the NVC level yet.

Thank you so much, Jay-Kay your advice was most helpful. My father in law did have the total number 2, I'll change it accordingly.

Looks like we're ready to file tomorrow!
