I797c /NOA1 questions

Hey everyone!

I received my noa1 today.. Never got the texts/emails but at least it came

My priority date is 4/3 and notice date is 4/9, what's the difference?

Also it says "the above application has been received by our office and is in process, but has been noted with one or more of the following exceptions: missing evidence(s)- your application was missing evidences that you will need to provide at the time of your naturalization interview. You will be notified under separate notice of the necessary evidences that you will be required to bring to your interview. Do not submit any evidences by mail"

Is that pretty standard or is this because I really am missing some stuff?

FWIW, here's what we sent:

• N-400 (original)

• A photocopy of both sides of Permanent Resident Card

• 2 identical color photographs, with name and Alien Registration Number written lightly in pencil on the back of each photo

• The inside of the front cover and signature page of spouse's current U.S. passport

• Our marriage license

• Proof of termination of spouse’s previous marriages

• Birth certificate of our son

• Consular Report of Birth Abroad for our son

• Our son's U.S. passport

• Tax return transcripts filed jointly for 2010, 2011, and 2012

• Joint lease agreements for 2011, 2012, and 2013

• Joint title to our vehicle

• Joint insurance for our vehicle

• Joint utility bills

• Heath insurance cards showing our coverage under the same account

• Drivers licenses showing our address together

• Summary of spouse’s life insurance benefits showing spouse as primary beneficiary

• Pictures of us together

Firstly, congratulations! Turns out you were fretting about nothing!

Secondly, in response to your query about differences in Priority Dates and Notice Dates: the Priority Date is the date your application was formally accepted by the USCIS. It is the ground zero of your processing timeline; in other words, Day 0. The Notice Date is the date the notice was generated. It's the same as writing a letter to a friend on Friday confirming that you received a package she sent you the previous Monday. The Priority Date is the relevant date to quote when referencing your application to Immigration Officers with the USCIS, the Notice Date does not apply.

Thirdly, your notice response is not standard. Further to this, it stands out all the more so because the reference to missing evidence is included in your I-797C and not the follow-up Yellow Letter that usually appears around the time you get placed in line to interview. Perhaps you were indeed thorough with your petition under the three-year statute, but let me ask you this: under what qualification have you applied to the Nebraska Service Centre and not the Dallas/Lewisville or Phoenix lockboxes?

My understanding is that petitioners with special circumstances only are entitled to apply at the Nebraska Service Centre. If you are eligible for one of these exceptions, but did not include the evidence entitling you to the exception, that might explain the non-standard response in your I-797C.

That said, this is no reason to fret just yet. The letter has clearly indicated that you will be given a chance to correct this as your petition works its way through the process. There is nothing to indicate yet that it could be delayed.

What can you do now? Call the USCIS 1-800 number and quote your application number. It is highly unlikely that the attending officer will be able to give you information specific to your application at this time; however, he/she may be able to inform you generally what additional documentation must be included when submitting petitions to the Nebraska Service Centre and then you can determine whether or not your original submisison complied with those requirements.

I honestly don't think the Original Poster should fret, but the letter does stand it because it's very rare for initial notices to note missing evidence. I say there is no cause to fret because the same letter clearly indicates that she will be given ample opportunity to supply that evidence in person at the appropriate time.

I guess I'll wait and see! I'm thinking it's maybe the speeding tickets? That or I made a mistake somewhere on the form which I doubt coz I quadruple checked before sending!

Well in the off chance that the missing evidence is due to my traffic citation, I called the district office and asked for a receipt and they are mailing it today, so I should have proof for that. I don't really know what else it could be!
