Dear VJ friends,

I am glad I heeded the advice of my lawyer and good friends.

Lawyer's advice: "Go back and visit her a second time before marriage. People change. Stories change." He was so right.

My Friend's advice: (my friend is a Filipina transplant from PI, now residing in Hawaii) "Stay at HER HOUSE!!!. DO NOT go to any PROVINCE (another island) they will trap you!!! and DO NOT stay in a hotel. All of your doubts, and questions, will be answered."

It appears, VJ friends, that my fiancee had been lying to me all along; so now a billion questions flood my mind; was she on birth control? another boyfriend on the side? did she steal/kidnap/use another white skinned baby (we are both light skinned in color) Why lie about the whole pregnancy process? Was she even pregnant at all? Why were there no pics during her last trimester? The white skinned baby in the picture looks like me, since I am Asian and have typical Asian eyes. The brown baby, doesn't even LOOK LIKE HER NOR ME!!! #######!!?? But that is the baby that was at her house; my gut instinct was: "That's not the same baby u showed me in the pics leading up to my 2nd PI trip!!!"

She said: "My grandmother cut his hair. He stopped drinking milk for 2 days. That's why he lost weight. (Was 9lbs when he was born). I, and my aunties take him out everyday in the sun, that's why he's so dark. I don't breastfeed him anymore because it hurts my breasts too much."

LIES!!! ALL LIES!!!

We planned to go to Saint Luke's for a PATERNAL DNA test, but that same morning, I was shocked to see $200 USD STOLEN from my wallet. Pissed off as heck, I got the hell out of Dodge and booked a flight back home immediately.

More shocking? No fight! No resistance! She just said "OK, you can find your own way back to the airport, right?" WOW!! If I was truly the father, wouldn't you be begging me to stay? She wanted me to go to Mindoro to visit her HUGE FAMILY that only NOW she reveals to me; spidey senses thought otherwise. Friends, I am back home, safe in the USA, Hawaii, with empty pockets, and gaping hole in my heart.

What is the exact time frame she has before her K-1 VISA expires?

Glad to be safe and at home in the USA-

I think we are missing the first part of the story, like how careless you should be if she "got pregnant" after visiting her for the first time in your life, but in any case if she already got here visa she can enter USA, but if she doesn't have her visa yet then you need to cancel petition immediately or she can try to obtain a visa

Ooohhh mmmyyy! Sorry to hear about your experience. Look at the bright side, you have discovered it before she scams you further! Kudos to listening to your spidey senses!

Which part of the K-1 process are you now? If your I-129f is still at NVC, call NVC and uscis to cancel the petition. If it has been transferred to US embassy in Manila, contact them and uscis as well.

Visa validity is 6 months after medical. But don't just wait and let it expire, as I have read of experiences here that the visa holders didn't inform their petitioner they're coming over to US.

So she faked a pregnancy and had two fake babies? You mention that you didn't see photos of her in her third trimester, didn't you talk online or anything and see her?

Wow, this is...quite a story. I feel bad for you, man. I've never heard of Filipinos taking babies out in the sun, that would be straight up crazy, given the intensity of the sun there. Someone correct me if I'm wrong, my wife's with my son at a swimming lesson so I can't ask her at the mo. However...people do crazy things all the time...so it isn't impossible.

Those pictures look like two different babies. I am wondering, however, if you, you know, went to the hospital where the child is supposed to have been born and talked to people there/asked to see the birth certificate? I'm assuming you wouldn't have let your then-gf give birth at home...right?

Are you positive she was the only one who could have taken that money?

I agree it sounds like you have it right - were it me, I'd want to be 100% sure, rather than 98% sure....

Its probably not necessary to post pictures of the babies

Disagree, it's illustrative.

Welp. At least I'm getting a ton of replies on MY DAY OFF since I'm still technically on "VAC", and this time a lot more intelligent people than the last few times I've asked questions here. So, to answer some of yours, VJ friends-- here we go--

She just sent me a copy of the H.D.F. (Hospital Discharge Form) from Makati Med Center. Trouble is, when I try and google the names of the 2 doctors on the forms-- nothing. At all.

I have pictures from her first and second trimesters-- but-- she is chubby, so I'm sure 4 months to 6 months vary from human to human. Every woman is different.

I've kept in constant contact with her except during February 20th to end of the month-- when my father passed away-- I shut the entire world out-- bad timing, really hating this 2014 thus far. Really painful experience. I've supported her financially for the past 9 months. We talk daily. But it is strange. I'd have to BEG to see preggo pics-- it was always "I'll send some later" and it looked legit.

I've tried magic jack and viber to call the PI; but it doesn't work; I think u gotta pay to do that. So, I've taken to social media and tried to ask some friends if they could contact M.M.C. for more info.

Case Creation Date: 24-Dec-2013 Status Updated Date:

10-Feb-2014

She's already passed the medical and the interview process. VJ friends, this is from the CEAC.state.gov web site. Any advice on what I should do at this point? I thought it wasn't possible for her to even come to the USA; and even if she did, doesn't the rule state that we have 90 days to marry upon P.O.E. or else she gets deported back to the Philippines?

When was she interviewed?

If the visa has been issued and no contact with USEM or CBP or DHS to cancel it, she can get past POE, and just stay illegally.

Instead of relying on google, why don't you inquire with the hospital about those doctors? See if you can make follow-up appointments with them to discuss the child over the phone.

As far as the rest goes, I'm sorry to say that it is very hard to follow your story. You obviously know your situation very well, but, being unfamiliar with the facts, it's hard to tell exactly what happened here.

I see you have a partially filled out timeline that suggests you had petitioned to bring this woman to the US on a K-1. You also state here that she apparently passed the interview and got the K-1. Ok. So how long has she been in Hawaii and why has she been there and not with you? And what is the timeline of her pregnancy claims? What is the broader timeline of your relationship?

Without knowing the story more clearly, it is difficult to give advice. It seems, however, that she came on a K-1 and, at this rate, is not going to fulfill the 90 marriage requirement in order to adjust status. She did, however, possibly give birth to a baby (possibly your baby, but maybe not) in the US very recently. So what will happen to her? Well, as a practical matter, she can continue to stay in the country illegally almost indefinitely unless she commits a crime, at which point she'll get on the radar of ICE. She will likely have a very difficult time adjusting legal status, but even that won't be impossible in the medium to long run if she marries someone else. If you filed sponsorship papers for her visa, you may be on the hook if she claims government benefits for herself and the child, even though you did not marry her.

Long story short--it sounds like you got into a bad situation and may even have been scammed. While you found out "early" relative to many who come to post their woes on this board, it seems you did not find out early enough because she is state side and that may cause you troubles. It's not popular around these parts (it seems many older men think it completely normal to "fall in love" with younger women over the internet and then petition for them after meeting them only one time), but I think good lesson from this sort of case is that anyone wanting to petition for a fiancee should first meet their fiancee and her family several times if at all possible. It's no coincidence that these types of stories all follow the exact same pattern. The pattern is pretty obvious if you aren't willing to blind yourself to it. (This is not to say that every person who only meets their erstwhile lover only one time is going to get scammed--there seem to be several relationships around these parts that are very successful despite limited pre-marital contact and I don't mean to take anything away from those--but it seems to me that almost every scam follows this type of arrangement.)

In any case, it seems you may have a fairly competent lawyer. I'd circle back to him about the implications of your fact-finding trip. But just get ready to feel relatively powerless as what happens next will be almost entirely out of your hands.
