Joint sponsor question

SCENARIO: I am the U.S. Citizen sponsor filing for my wife. I am currently unemployed and although have quite a bit in assets I was recommended to use a joint sponsor. My parents are both retired and individually do not meet the 125% of poverty guidelines, but when combined they do. So I intend on using them both as joint sponsors. However I have been living abroad with my wife for soon to be 3 years, I do not live under the same roof as my parents, but we share the same permanent residency.

My question is, would both of my parents complete the i-864a form because we share the same permanent residency?

or

Would my father complete the i-864 (although we share the same permanent residency, I actually am not living under his roof) and my mother complete the i-864a form because she lives with my father?

I read the instructions over and over and even called and received different answers to the same question (when someone would answer me). Much is appreciated!!! Thanks to all!

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Correct, but you the petitioner will also provide your own I-864, even if you have no income. Make sure each of your parents remember to provide evidence of their US Citizenship with their package.

Along this topic, I have some follow up questions. Since my father will complete a i-864, under Part 5, considering that my wife and I aren't currently living with my parents (the same household) what exactly should my father write in this section? It just seems to me that if my father completes this section then it will basically be stating that my wife and him are living under the same roof, which is not the case and the whole reason why he is not filling out the i-864a in the first place. Sorry, I'm just really thrown off by this.

Also, I have another question, but for my own i-864 form. Under Part 6. 13. the form has a box to mark in if "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Feneral tax return for only the most recent tax year". When I read this I see two separate statements within the two separate sentences; one stating that I indeed do the past three years of taxes and another stating that I am sending a copy of my latest taxes. My question is what if I didn't complete 3 years worth of taxes (only two), however am sending a copy of my most recent tax year? Would I mark this anyway and within my letter of explanation of this and that included in the packet explain with details of why I checked this?

Your spouse is counted as the intending immigrant, on your father's I-864, not as a resident in his home. You are not counted in his household unless he is supporting you. If he is, you are simply one of his dependents, whether you live with him or not. Your father is not providing an I-864a because he is not combining income with you to qualify as sponsor. It's also the only way to account for his actual household size accurately.

Yes, I would check the top box indicating you're sending one tax return. In the section the asks for information from past tax returns, fill in the year and number on the top line for 2013. In the space available below, simply hand write/print legibly, the reason you didn't file previous years. Usually, it would be something like. "Not required to file. Income below filing threshold."

Thanks so much, once again! You really cleared things up for me.

Sorry to ask another question, but I think this may be my final one. Since my father will be completing his i-864 and my mother a i-864a, on my father's i-864 on Part 1 would he mark in 1.d. or 1.e.? I am thinking it would be 1.d, because the i-864a is stated to be a "Contract Between Sponsor and Household Member" with my mother being the household member, but it seems a bit odd to me since she will technically be a joint sponsor.

Thanks for the help and I appreciate all that I can get. Sorry in advanced if someone has already answered such a question as I did search already.

Your father is the only joint sponsor. Your mother is a household member, not a joint sponsor.
