The misses and I tied the knot on Friday! Long time coming. Now I have to deal with a woman who wants to work and cannot - this is going to be fun... :) So now I am guessing we need to apply for change of status with form I-130, is that correct? I am guessing this starts the green card/work permit process. Anything other than a marrage certificate required? Thanks much.

Congratulations on getting this far and on getting married.

What you need to do now is download and fill out the AOS forms I-485 (Application to Adjust to Permanent Resident), I-864 (Affidavit of Support) to prove that you make enough money to support your now spouse. I know your question is, "Thats what the I-134 was for wasnt it?" Yes it was, but that was not a binding agreement and this is. As well you will need the I-765 (Work Auth) and I-131 (Advanced Parole) so that you can travel during the process before you get the green card. The advanced parole and work authorization you should receive within 3 months and the green card application will take anywhere from 4 months to a year. If you have any questions about the forms or what to include or what I included just PM me. You are going to need to wait for a certified copy of your marriage certificate before you send anything in.One last thing, just depends on what you want to include. In my package my wife and I included pics of us at the wedding as well as pics with friends and family from the wedding (personal preference). Hope this helps and is not too much info. Apps I took on my case wish is pretty similar like yours

Forms

I485 ---- AOS

I765 ---- Work Permit or EAD

I130 ---- PEtition For Alien Relaitve

I693 ---- A seal envelope giving by certified surgeon

I864 ---- Affidavit of support

I130 ----- AP Advance Parole

G-1145 ---- E-Notification (optional)

and along with this the amount of 1.490.00 in money orders or check also all supporting documents for each form, I did it my self and it took me around 2 months to have everything together......

  • (95 Days) 05-13-14 ----- I485 interview date sent for June 16, 2014
  • (134 DAYS) 05-16-14 ------ INTERVIEW DAY........ OUTCOME IO SAY THEY WILL MAKE A DECISION IN THE NEXT 30 DAYS
  • (143 DAYS)06-25-14 ------ - E-MAIL & TXT RECEIVED FROM USCIS STATUS CHANGE FOR CARD/DOCUMENT PRODUCTION THANK GOD....!!!!!!
  • (145 DAYS)06-27-14 ----- GC ARRIVED TODAY IN THE MAIL........

Post #3 has really bad info, it not pertain to your wife's visa type or type of adjustment of status.

Got the forms filled out and ready to be sent. Got the following:

I-485

I-131 w/ additional explanation document

I-765

G-325A

I-864

Copies of my last three years Tax Returns

Copy of my last W-2

Copy of her Passport ID page and K-1 Visa page

Copy of I-94 Admission Number Retrieval web page

Anything additional I should send? Advise on other documentation or what to say?

Got you - that is where I got my info and the forms. As for the I-693:

"If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination."

She had her exam in January 2014 with all shots.
