k3 aos and ead while in canada?

Timeline

Hey there,

Just wanted to get a few ideas from those out there.

(No offense Riblet..!! :blush: just wanted to see what other ideas are available!!)

here's the question:

Both I-129F and I-130's got approved in December.

My I-130 got retained, and I've since sent in the I-824 form

for application to transfer my file to the NVC. So far no news

and I don't expect any for awhile.

In the meantime, by I-129F K3 was transferred to NVC

and I rec'd my first packet. I intend on applying for both

Visa's and see how far I get.

Obviously the I-130 (CR1/IR1) visa would be the optimal

choice, however, depending on the waiting times, the K3

may be the way to go, even though I would have to adjust

status afterwards...

I plan on moving to the States to be with my hubby in July of this year.

IF the K3 is approved sooner than July, can I do the EAD/AOS from Canada

until I officially move to the states? Please advise with thanks.

08/28 - I129F - Received by Chicago

08/30 - I129F - Received NOA1

10/23 - I129F - Transferred to VSC

11/01 - I129F - Package rec'd in VSC

11/02 - I129F - Touch

11/03 - I129F - Touch

11/04 - I129F - Touch

12/15 - I129F - APPROVED!!! WOOWWIEE!!!

01/05 - Rec'd packet from MTL consulate

08/25 - Medical Exam

08/29 - Interview at Montreal Consulate / K3 Approved

09/07 - Entered USA via Champlain, NY border. All is good.

CR1 Process

I-130

07/01/06 - I130 - Mailed to VSC

07/14/06 - I130 - Received NOA1 (I-797C)

14/12/06 - I130 - ****APPROVED **** WOOHOO!!!! / But Retained..boohoo...01/03 -

I-824 sent to INS for Transfer of I-130 to NVC

01/09 - 200$ check cashed. No confirmation in mail yet..

01/11 - Touch

01/13 - I-797 receipt received in mail...

01/31 - Touch

02/01 - Touch[/color]

07/31 - Approved I-824 / Sent to NVC

09/12 - Choice of Agent Rec'd and sent back to NVC

Timeline

I beleive that once you have K-3 visa you will have to travel to the USA first to "use" the visa, then file AOS, and EAD. after that you can travel back to Canada and wait for the EAD and AOS interview, I believe that it will cancel the CR-1 visa process since you are then adjusting state side, it is either wait for AOS or wait for CR-1.

Once you get interview, and biometrics appointments you will need to travel back to the USA to attend those.

Sounds like an excessive ammount of fee payments trying to do AOS, and CR-1 at the same time.

Is now a US Citizen immigration completed Jan 12, 2012.
