Hi all!

I'm new to the site and planning to petition for my daughters and wife once I get LPR card.

Also I was wondering if someone can advise me on what forms I need to fill out and what visa category do their cases fall under?

Appreciate all of your help.

Thanks!

That depends.

Why are they npt getting GC's when you are?

I am currently being petitioned by my eldest daughter who is a USC. My case is currently at NVC stage awaiting for case complete and interview. So, once I arrive at the US and get my GC, I plan to petition my 2 minor children and wife so that we can all be together.

Well both your wife and daughter will be filed as F2A category , However , you do need to file the petition separately.

You'll need to file I-130 for both of them.

Since you're not usc , bear in mind that it can take much long time. I'd say your elder daughter should file for your wife and you file for your children. So it's a 100% guarantee that your wife will be there without any effect by VISA Retrogression.

Actually at the moment it is pretty quick, couple of years.

Well, both of my minor daughters are currently in college. One has 1 more year left before graduating and she just turned 18 and the youngest will be starting college this year. I noticed that USCs cases are processed the fastest but I'll have peace of mind that I'll have my wife staying with my daughters as they are teenagers. My question is, how long usually is the processing for this type of visa? Also, with filing separate I-130, do I have to pay the fee separately which means $420 each?

Yes you'll pay each of them separately ( both AoS and IV fees ) , hmm you're right 'bout that , your wife really need to stay with your daughters.

I'd say 8-14 months , it's really depend on your embassy and the visa numbers allocated each years per country also the retrogression thingy.

For instance , read my sig and you'll know that my parents start the petition for me since June 2013 and now still nth new beside my case has completed and waiting for interview.

To sum up, it's around 8-14 months.

p.s you'll need to request NVC should you want all of them to have the same interview date.

Good luck

hi

actually one of your daughters can be under your wife's i130 as her derivative, because she is a minor under 21

so you would only need to file 2 i130

but do they really want to come and live here, since both of them will be going to college in their country?

I figured while going thru the process, my daughter can finish college and obtain experience while the youngest is only taking a 2 yr college degree as a start since she is very undecided on what course to take.

Appreciate all of your replies..

You only need to file one I-130 petition for your wife. All your minor children qualifies as derivatives. You need to file as soon as you can as one might age out. I suggest you prepare in advance the I-130 with all supporting documents and send the package as soon as you get your GC. Remember that in order for a child to be protected by CSPA, her PD must first be current. Well, 3 years is a lot of time but delays happen. You will only pay $420 for your wife's I-130 but when it comes to NVC stage, you will pay $88 for AOS fee and $230 for each beneficiary (wife as principal, daughters as derivatives). You will definitely need a co-sponsor for 3 people. Hope this helps and good luck.

Thanks for all the advises! I'm gathering civil documents here in PI before I leave for the US and was wondering. What else do I have to provide for civil documents other than my daughters BC, my wife's BC and our marriage certificate. Is this all I need? Also, when petitioning for them, do I have to provide original copies of BC and MC in each beneficiary or can I just send all in one coz these documents are pretty expensive.

Follow the instructions.

Send photocopies with the I-130.

Read the Guides. Download and read the forms and instructions.

aaron2020 is spot on.

Make sure you only get NSO certified copies, not from anywhere else. You will need the original NSO-certified copies when submitting civil docs to the NVC. DO NOT send original copies with I-130 as these will not be returned to you.

For the I-130 application, you will also need to download form G-325A. Have your wife fill this up and SIGN. Bring this SIGNED and completely filled up form with you when you leave for the US. You might also want to have her sign multiple blank copies of the signature page so you have them ready in case there are corrections. This will save you time as you can just fill out a blank and signed G-325A of your wife instead of having her send you a new form. For the entire process, this is the only form that needs her actual (not photocopied) signature.
