I have a question. I sent my Affidavit of support documents in december of 2013 . I sent them my 2012 tax transcript. Now Her(my wife) Interview is expected in June 2014. Will they ask for the 2013 tax transcript as well in the interview? I filled my taxes as a head of household for 2013 in january as my mother is my dependent. Please help.

Since it is not that difficult to get tax transcripts from the IRS, and Tuesday is April 15th and unless you filed for an extension, you need to have your taxes filed by Tuesday, I would get just your 2013 tax transcript for the interview. If not needed for the interview, you will need them for removal of conditions (ROC) in two years.

Good luck,

Dave

Yes i think you are right. i was just scared because i filled it as a head of household and did not mention my wife anywhere in the form because she's not in USA. only showed my mother as my dependent. Hope that will not be an issue.

The USCIS uses tax returns for two purposes: 1) that you are complying with the laws of the US where you as either a LPR or USC must file taxes on world-wide income or explain why you are exempt per IRS rules, 2) that the income claimed is valid and true based on the income reported to the IRS. They are not tax experts and do not know why you claimed your Mother nor do they really expect you to file married filing jointly with the other spouse out of the country as a SSN or ITIN is usually required plus as a non-LPR they are not required to file.

You will be fine,

Dave
