Hello, I got an RFE today and I am so nervous as I heard it's entirely not good to get that... Please you guys help guide me on what to do. The RFE goes in part thus, (1) The petitioner/ sponsor's income on the federal income tax return does not meet or exceed 125% of the poverty guideline. The petioner/sponsor list their current income on form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of current income. Please submit evidence of the petitioner's/ sponsor's current income. Such evidence should include: Letter of employment containing the following: Dates of employment, Nature of the job, wages or salary earned, number of hours per week worked, prospects for future employment and advancement, Pay stubs or other documentations of pay for the previous 6 months, evidence of other income, such as Tax- Exempt Interest, Qualified dividents, IRA distributions, Pention, Annuities and social security benefits ( only SSA-1099 and/ or SSDI-1099.... My wife can have her work write the employment letter and gather all other papers but how much should be in the closing bank account statement to make them see it as sufficient..Again, must we also include the tax exempt interest amonst oother?

(2) The RFE letter also stated... Based on the documents submitted with the form I-864, affidavit of support, for the petitioner/ sponsor, the income did not meet 125% of the federal poverty line for the petitioner/sponsor's household size... submit evidence of assets that meet the standards listed listed below or obtain joint sponsor. Assets standards must equal the stated difference between the sponsor's household income and 125% of the federal poverty line... Assets must equal the diffrence for applicant's filling as orphans or spouse or child of an active duty military member, Assets must equal three times the difference for a spouse or child of a USC, Assets must equal five times the difference for all others. Such Evidence of assets includes: Bank statements covering the last 12 months or a statement of the bank or other financial institution in which the sponsor has deposits, including deposit/withdrawal history for the 12 months and current balance, Evidence of ownership and value of stocks, bonds, and certificates of deposits, Evidence of ownership and value / equity of other personal property and dates acquired; Evidence of ownership, a recent licensed appraisal or county tax assessment and any mortgage/lien release of any real estate...My question is, Can we get just the bank statement for the 12 months and title deeds for our two vehicle and leave the rest as we don't have them. How much would they see as sufficient current balance for the bank statement?

(3) You have submitted a statement on government letterhead establishing the non availability of your birth document. However it does not contain one of the following: A legible seal, A legible Stamp, A signature with a title containing the words: secretary, registry or births and deaths, Indicates the reason the record does not exist. You must submit a statement of government letterhead indicating the reason the record does not exist that contains a legible seal, legible stamp or signature with a title containing the words: secretary, registry or birth and deaths...

I am in shock as to all this and please, I beg you guys to give me an input on what to do about all this. I self filled and didn't use a lawyer.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Did you send in the I864 with your papers? The US citizen has to fill this out and send it along with current income taxes or tax transcripts. there is a sample form for you to look at under examples. Go on the uscis site and get the form and the amount of income. For 2 people its 19,xxx. If its less, say u make 11,000 then you need 8,000 x 5 in cash. If you have enough income, you dont need bank statements. If you dont have a birth certificate, you must get one or get a certified letter from the court explaining why its not available.

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

1. You need to provide proof of current employment, either 6 months of paystubs or a letter from the employer.

2. IF you do 1, it will erase the need for 2.

3. You need to get another statement regarding your lack of birth document. The one you sent is not good enough. They tell you exactly what you need in the last sentence.

It says they are generally available for people born after 1970. Were you born before then?

Assets are calculated at 3 times for a USC sponsoring a spouse or minor child.

Hey, ....i really don't know much about how you filled out your form 1-864, but really you don't have to use ur spouse if they didnt meet the deadline...cuz if their income is really insufficient then it could be a problem or rather make ur friend or someone else do that...

Also the issue of birth cert.it happened to one of my buddy in Ga....what he did was he went to the Nigeria embassy in Washington or atlanta not too sure to get a letter and a consulate issued stamp along side with court certified copy of absent of birth certificate and i think you should do that do....well if you cant travel there you can bug them with call they will definately do it....... But regardless GoodLuck

Yes, they really do. Even if the petitioner/sponsor spouse does not meet the income requirement, they still have to fill out an I-864. If they need a joint sponsor, then they can use one, but using a joint sponsor does not mean the primary petitioner/sponsor does not have to provide the I-864 and supporting documentation as well.
