I saw somewhere that you now only have to submit 1 years tax returns on the I-864 did I read wrong or can someone send me the posting where its now only one year tax returns. Thanks all

By the way Iryna and I were married in a beautiful wedding on the 18th of February and we can't be happier together.

NOA 2 received via snail mail 09/10/2005

Petition sent to NVC notice via email 09/08/2005

NVC assignes Visa Number 09/21/2005

Received via snail mail Letter from NVC telling my case number 09/27/2005

Received Email From Warsaw Embassy that our file was there and its ok to fax in the Check list and DS-230's 09/28/2005

Received Email from Iryna that checklist and DS-230's have been faxed into the Embassy at 11:15Am Warsaw time 09/28/2005

Received Email telling me Iryna's interview date is 11/03/2005 at 8AM 10/03/2005

Iryna received via snail mail her packet 4 with her interview date and time of 11/03/05 at 8:10am 10/11/2005

Yes, only the most recent tax year needs to be sent in.

May I ask where you found that information...? I printed out the most recent version of the I-864 a few days ago (the 11/05/01 version) and it says in the instructions that the last 3 years are needed?

page 2:

"A copy of your complete Federal income tax return, as filed with the Internal Revenue Service, for each of the most recent 3 tax years."

So I am confused now..... :huh:

Also one other question:

If my husband hasn't filed his taxes yet (which I think he isn't obligated to until the end April or so?) but we want to file for my AOS as soon as possible, would it then be ok to use last year's tax returns as "the most recent one" or would that make USCIS suspicious that we might want to hide something etc....?

USCIS has now also updated the information re: 1 year tax return on their website. It hasn't made it into the PDF form yet, but it is on the page right before you download the I-864.

From http://uscis.gov/graphics/formsfee/forms/i-864.htm

"Special Instructions:

All sponsors must submit the following documentation with their I-864:

* Proof of current employment or self employment

* A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.

You may also, at your option, submit a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax returns for your second and third most recent tax years if you believe these additional tax returns may help you establish the ability to maintain your household income at the governing threshold set forth in Form I-864P, Poverty Guidelines."

"When all else fails, read the instructions."
