What is your brother's priority date?

Yes, he can bring his children with him. He or his petitioner will have to inform NVC (by email) about the children. Prepare the children's NSO birth certificates and passports.

Thanks right now he is current and we are waiting for the medical and interview. By the way what kind of forms should we fill up. Tnx again

You have to inform/call NVC ASAP because they need to include the children in the immigrant visa payment invoice. Your brother can send an email saying he wants to include his children on his F1 petition. Attach a scanned copy of the children's NSO birth certificate and the bio page of their passports.

Did your brother already filled out the DS260 (Choice of Agent) on the CEAC website?

If we include and or inform the NVC about my brothers son, we are worried that his F1 category which is current right now will be affected or will be invalid and put him on f3? Please help us! I thought in PI the Mother had control?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
