Limit on K-1s from previous marriage?

Hello and greetings! I have went through the forums but have not found this subject. So I have 2 ex wives both of which I brought over to the USA with the K1 fiancé visa. The first lady was from Russia and the second Lady from the Philippines. Sadly they both ended in amicable divorce. Okay so I have for the past year I have chatted with 3 times a day and visited once a wonderful lady in the Philippines. We have decided to get serious and I was planning a second trip to see her but today got a bombshell dropped on me. I was told that there is a 2 K1 lifetime limit and that basically since I have used up 2 already I cannot bring her over here. Is this true? ANy advice? If so I will be heart broken.

I really hope this is incorrect.

Sorry but per the I-129F Instructions that appears to be correct... you would now need to additionally apply for a waiver...

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

2. What Filing Limitations Does IMBRA Place on K-1 Nonimmigrant Petitioners?

You must apply for a filing limitations waiver if any of the following apply:

a. You have previously filed K-1 petitions for two or more beneficiaries; or

b. You previously had a K-1 petition approved and less than 2 years have passed since the filing date of such previously
approved petition.

To request a waiver, submit a written request with this petition accompanied by documentation supporting your claim
to the waiver.

So the better option would be to get married in the Philippines? And bring her over via K3? My concern with that is how long would we be waiting for her and her daughter to get approved if we did that? Does the K3 IR1 take longer?

Do the CR1 spousal visa. No you don't need a lawyer.

You are 100% wrong. A CR-1 is NOT a K-1. The limitation applies to a lifetime limit on K-1 visas. There is no lifetime limit on CR-1 visas.

Quit giving misleading, incorrect advice.

No, I think she's right. Right on the money in fact.

He needs a lawyer, or to at least confer with one, not because he already has had 2 k1's, two failed marriages where the beneficiaries ended up here and with Green Cards. He needs a lawyer because he has a convoluted and perhaps difficult history to over come.

The "waiver" for permission to apply for more than two K-1 is just a letter that you send with the petition asking for an exception. Getting out of that requirement and doing a CR-1 does not free him of his own history of being a personal immigration portal. The US gov has checks in place to prevent people from becoming personal immigration portals. This visa itself doesn't matter as much as his own past, and either way he will have more to overcome than ever before to prove this is a valid relationship.
