I am an USC and applied for I-130 for my mother, I received Notice of Action (Form I-1797C) with Receipt Date of Aug. 7, 2013. On Jan. 28, 2014, I received a letter saying that my appn. has been transferred to Texas Service Center in Mesquite, TX. I was hopefully finally something was going to happen.

Instead I received a letter from USCIS dated Feb. 15, 2014 that they need my Birth Certificate and Beneficiary's Marriage Certificate.

My Birth Certificate:

I do not have a Birth Certificate. As an alternative, I already sent in the following documents along with my ORIGINAL application.

1. Affidavit for my birth from my Aunt.

2. Affadavit for my birth from my Mother.

My mother's Marriage Certificate:

My mother does not have a marriage certificate. As an alternative, I provided a copy of her passport which shows my father's name as her husband.

I feel USCIS is asking for the same information AGAIN that I already provided without looking at the alternative documents I sent in to them.

What would you suggest I do at this point? Your comments and suggestions would be highly appreciated.

Sonny

What did you use when you immigrated?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

You need affidavits from two persons who were living at the time and who have personal knowledge of the event. Affidavit from your Mother does not count because she is the beneficiary. But uncles, aunts, parent's friends, any grandparents etc. will count. They do not have to be US citizens.

Ideally you should have two affidavits for Marriage (parent's) and two for your birth (mentioning your parents names, date of birth, place of birth etc.).

I had to go through this petitioning for my parents. Send me a private message if you want more help.
