Bad advice. No one should ever lie to immigration officials. He isn't married yet, so he cannot say that he is. Neither can he file at this point because he is not married.

He said he already got married. Read his posts before acusing me of giving bad advice. I would not tell someone to lie to and ICE officer or any other type of person with authority specially in these type of circumstances.

He should seek a lawyer, and call the ICE officer to tell him what he is doing and his intentions. Simple as that

Either way the outcome to this scenario is not looking good..

I really appreciate all your help guys. I have found a lawyer and we are going to get in touch with the agent. I only have the license and I am getting married next week. I can prove the relationship legitimacy with pictures, messages from the past and even other people supporting us. Everything in terms of me and her is legit. According to what you are saying, the outcome doesn't seem to good, and if I manage to do everything on time and have luck on my side, I will still have to spend my whole savings, and loan money to get this done. First I will let the attorney contact the guy to see whats up before I go ahead with anything. Thank you once again.

about me:

I came to US in aug 2011 to study at pennstate hazelton,

couldnt afford it so I had to leave school.

Found ways to make money online, and also offline but all through cash.

I met my soon to be wife on october and have been together ever since then.

OP's opening statement on line 3:

So...... He is married

And the fact he is now married and filing AOS has been discussed throughout this whole thread.

You are giving him bad advice, he has just posted that he is NOT married. He can't file until he gets married.

Awww sorry... Gotcha... major misread, my bad.

OP... I have to agree with the advice other VJ Members have given you... I think ICE officers turning up at your door, and then a sudden wedding days later is not going to bode well when you file AOS.

For all the money you would need to spend on filing AOS I would instead use it to hire a reputable Immigration Attorney who specializes in cases of this nature. I think the position you have found yourself in is far beyond anything us guys can help you with.

But I do wish you lots of luck... please keep us all posted on how things turn out for you both (L)

A number of posts have been edited to remove advice condoning or suggesting illegal activity - which is a violation of the Terms of Service for Visa Journey. A number of other posts have also been edited to remove the quoted TOS violations.

Please remember that not only is it a violation of the Terms of Service for Visa Journey to suggest or condone directly or indirectly any sort of illegal immigration activity or misrepresentation, lying, misrepresentation or illegal immigration activity is taken very seriously by USCIS. They can and do find out, and misrepresentation is one of the grounds that can lead to deportation and a permanent ban on ever being allowed to live in the US.

The OP has received good advice to consult and retain a lawyer. While he will have legal grounds upon which to file for permanent residency once married to his US girlfriend, because of the circumstances surrounding this marriage he will have an uphill battle to prove that it is a valid relationship and not a marriage of convenience. Whatever happens this process will not be easy - but it will become impossible if at any time, the OP lies or misrepresents himself or the facts, to USCIS and ICE.

You were/are working illegally. Illegal work will not be a bar to your adjustment, however, tax evasion will be. Tax evasion is a felony. You need to file your back taxes and declare all the income that you made.
