i m really amazed that medcaid has caused the cancellation...

You gave contradictory information.

You said:

1. I have sufficient assets to receive an E-2 visa. I have an income producing business in the US that provides significant benefit to the US economy and I have a significant income in the US.

and you also said

2. I am so poor I cannot pay for my wife's medical bills so the US government needs to pay for them. You have to fill out a form swearing to your assets and income and they have to be below a certain amount to qualify for Medicaid.

Do you see the contradiction? The embassy decided to go with your statement #2 when they cancelled your visa.

Well i do have a business and i guess you didnt read the original email, without assets would i have a visa and an income? i never said that i m poor such that i cant pay her bills...ok lets sy i did take medicaid , wasnt the hospital staff sane enough to say that since ur not an emergency case medicaid cant be provided since my passport copy was also given which mentions my status.

and if they had to cancel my visa then y do such a drama act that u need to come to the consulate to have a re interview they should have just told me that ur visa has to be cancelled thats y we are calling you.

The hospital staff are not immigration experts. They are also not responsible for maintaining your status. You are responsible for knowing the restrictions on your visa.

Instead of looking to blame the hospital and the US Embassy, you should blame yourself for violating the terms of your visa.

Hospitals don't know anything about immigration laws. They don't care if you are legal or illegal, they are in the job of providing medical care. They will do whatever they have to so they get paid for their services.

Your visa has been cancelled. If your spouse and any other derivatives of the visa are still in the US they need to leave. You can apply for a new visa whenever you wish.

As others have said -- not the hospital's responsibility to investigate the truthfulness of a patient's statement before providing health services. Your wife had to either claim to be an legal permanent resident or a US citizen in order to get the Medicaid payment. All the blame in this falls to your family, sorry.

The reason for the "dramatic: reinterview was to give you a chance to refute the information before the visa was cancelled -- in other words, they were being fair and giving you a chance. Since you had no means to refute what actually happened, the visa was cancelled in accordance with US law. I'm certain they saw a couple of problems -- as I said before in another post, it does not seem like you were in the US actively managing your business (the purpose of the E2 visa) for almost a year, yet your wife stayed there are your dependent -- out of status -- which she then made worse my using Medicaid. In applying for and using the E1 visa, you committed to go to the US, run your business, and comply with all of the laws and requirements associated with that visa -- including, for your wife, not accepting Medicaid and not remaining out of status in the US. Lots of issues in this case, none of which were caused by the Embassy or US law.

Sorry for the rant -- but it just seems you aren't getting what people are saying....accept the responsibility for your family's action, correct the things that are still not correct, and look for the path to move forward legally.
