My Fiance had a previous I-130 Revoked back in 2012!!! Should I worry!??

Hiiii!!! My fiance was married to this woman, and they were legit, the only thing is that she was older than him and she had tried to file a petition for someone else before him but it was discovered that she did it for immigration purposes therefore SHE, the USC was redflagged at the embassy. Then she married him (my fiance) after a few years and this time it was for real, not a scam marriage. Well, they went to the interview and were asked a few questions and it seems like they were approved but then, they asked her about his daughter, mind you, she dislikes the little girl< for what reasons, I have no idea, so she never had any contact with her so she knew nothing about her. To make a long story short, he didn't get the visa that day and they sent an intent to deny letter asking for more proof of a bonafide relationship. After this,he found out his wife had been living with another man here in the U.S. for months while making him believe she was by herself here and he decided to end it with her and cut off all ties (then I met him! he was still married but hadnt seen her for over a year :) ) but she submitted the request for more evidence, but they still didn't get approved and his I-130 got revoked, good thing he didnt get any fraud in his file, just a revocation of the I-130 that was previously approved...Also, I was married before for a little less than 5 years, I got my ex husband his greencard, but after a few months of getting his permanent card, the 10yr, he started changing with me, treating me bad, and cheating, so I decided to leave him. Do you think I'm going to have a problem now that I filed for fiance? I filed for his k-1 and got receipt date of April 1st, 2014 at the TX service center... PLEASE HELPPPPP!!!! Im also hoping for a fast approval at TSC, I have seen people get approved in like 45 days!. Our relationship is definitely legitimate, I been to DR since March 2012, 6 times to see him and he has met my family, I have met his family, his daughter, he's met my daughter, we tango, whatsapp, and talk on the phone 24/7 we have millions of pictures, i mean we know everything about each other but I dont want that previous petition to cause us any problems! Please guys, let me know what you think!!! oh, by the way, our embassy is Dominican Republic, yeah I know a high fraud country... :(

I was worried about my k1 visa petition as well. We had our cita march 25 and it was approved.

I had filed a k3 visa from my previous realtionship but we broke up after 8 years and then 2 years later I met my fiance. Me and my fiance have twins together and I filed a k1 visa for him.

Our interview went smoot h and of course my ex was brought up but if ur relationship is genuine then there shouldn't be any issues. I was worried my past would affect the outcome of my future but it didn't. As long as u havea genuine r elationship ur good.

I brang tons of evidence and wasn't asked for not one thing. So it all depends case to case. But I was prepared for whatever they threw at me.

Ufff thanks!!! For my ex, I filed for him here in the States, not in DR. How long did it take you from the time you filed until he got approved?? I got pregnant on my trip in October but a few days before Thanksgiving, i had a miscarriage :(... Didn't include any evidence of that in my K-1 application packet because we both just recently got divorced, so I didn't want to make it seem like if we both cheated while still being married, mind you we had already been separated for some time but due to financial difficulties we hadn't finalized our divorces but that is taken care of now :) I have tons of evidence, all my plane tickets, letters, text msgs, whatsapp conversations, tango video call logs, its ridiculous how much stuff I had. Can you please tell me what they asked you at the interview just so I can have an idea more or less? Thanks!

Do you have a Lawyer?

Fortunately, I work with an immigration lawyer, I am his legal assistant and hes coming with me to the interview, he's not charging me, we are very good friends and I prepared my packet myself so I am definitely not getting any RFE's since I Ssubmitted everything requested. But even though I work in the field, I get nervous since its my own case now. Now i know how my clients feel when they call me desperately to see if anything has been received loll :-D

U don't need a lawyer at the interview. Because the questions are based off ur application. The interview ventanilla space is so limted plus at the cita questions are ditected at u two because they want to know if u know about one anothrt

Yeah i know the space is limited, I was there with a friend in 2013 and its so damn hot!, well the attorney aka my friend, he also wants to visit DR so i told him to come with me jajajaja but lets see, I didn't see anybody going with an attorney so we dont wanna look stupid as hell going there with him lol

My personal feeling is that for a High Fraud country a lawyer will look more suspicious not less. And from personal interview experience if they ask you something and your Fiance answers or vice versa....(in your case perhaps the lawyer answers) They don't like it one bit! Read my review (included on my timeline) you'll see... They kicked my Fiance out and and then grilled the ####### outta me asking a bunch of rapid fire questions.. then twist my answers to be the opposite of what i just said and ask me again in such a way that if I wasn't paying attention and then I agree it's a lie...

I say No Lawyer unless later on you actually need one! Meaning if they deny it... Save the money.. go shopping... go for more visits or go to a resort together... jajajaja

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

I don't even know where to begin.

Seems like an awful lot of fraudulent coincidences.

Combine that with it being DR and I wouldn't bet dollars on your chances.

November 14th, 2013: She's here!
