you know whats funny about a month ago i called the customer service center, and asked the guy about the 129F and he was like "umm there is no such form as the I-129F" i mean really what are they people taught and what is their training period like. But yeah if they have not processed on in years when take it off the page and if they cannot meet their own time limits then dont post them. I do think thats also why they took the "Trends and Volumn" charts off the site

I haven't been to any of the USCIS offices site so didn't knkw they had that at one point .

i have 2 question guys please:

1- i filed my 2014 taxes to send it to the NVC with AOS package but i filed as single because if i filed as maried they need my wife SSN and of corse she don t have it so my question is it ok if i filed single even if i am maried abroad ??

2nd question : do my wife need to bring all original supporting document to the interview such as her birth certificate and mariage certificate .. etc and the AOS package ?

thank you for your help

Yes your wife needs all originals for interview

You should have filed married filing seperate in which you do not need your wife ssn . I think you would have to fix it and send the fixed document with your wife to the intetview IF nvc approves the case with the single filing . But if you get a checklist you can already have the updated taxes so you can send it back right away. This is from saylin wiki

Before I continue, I will say this once and only once: YOU CANNOT FILE SINGLE. If you are married, you are married. Doesn't matter where in the universe your spouse is, YOU ARE STILL MARRIED. You will be lying to the IRS if you file as single, and if caught, could cause serious issues. If you have already filed taxes, either this year or last, and were married, yet filed as single, amend your tax return ASAP. If at the time of the interview, there are tax return transcripts in the case file showing the petitioner filed as single, this can be a HUGE red flag. The CO will have to wonder why the petitioner filed as single when they're trying to get a spousal visa. In their eyes, your relationship can be seen as a fraud and could be reason for denial.

You do not need a SSN to files Married Joint. The form says enter SSN or ITN. My wife and I filed Jointly last year and all you have to do is request an ITN when you file. We did our taxes at H&R Block and they took care of all the paperwork

Yea If you can get a itn number situated yes you can file MFJ but I hear it's a hassle. Since you did it can you shed light on the process ? I was debating which to do but it seems like I had to send my husband a form to sign ect?

So what i needed was my W2, a copy of her passport, id card and birthday. I brought all that work into H&R filled out the 1040 and the agent filled out the ITN info and then sent it all off. I got my tax refun and the official ITN number and paperwork from the IRS in about 2-3 weeks. the whole process took about 15 min. but you will have to find a "trusted agent" who is certified to process and issue ITNs. you cannot fill out the taxes on your own it can only be done at a tax center. It was not hard at all to do, but your best calling the tax center and ask what documents are needed.

I found this confusing since the IRS website says to mail in the passport to get an ITIN number! No wonder no one knows what the proper procedure is and remains confused... smh

Exactly ! H and r block told me I couldn't do it at all! Then said I had to mail him something to sign because they need signature I just got all confused with the whole process and did separately and they took all my money and I owed them! So I left to read up on more before I go somewhere and do it offically . I'm just confused !

Exactly ! H and r block told me I couldn't do it at all! Then said I had to mail him something to sign because they need signature I just got all confused with the whole process and did separately and they took all my money and I owed them! So I left to read up on more before I go somewhere and do it offically . I'm just confused !

Yeah, after further discussion she told me to file MFS, print out the form and handwrite everything and to write "Applying" in the SS/ITIN box. She told me H&R accepts forms that way. However, I'm not so sure I want to write "applying" when technically that's not true. I think I'll just write NRA in the box. What did you end up putting in that box?
