Hello All,

Nevermind my timeline. My wife is already a permanent resident for 10 years. =) Of course thanks to all the help from members of VJ.

My question pertains to my friend's situation as I am assisting him in his process. Through my own, I have gained some experience about the AOS, but not through Fiance visa.

I hope all of you can be kind enough to offer some opinions on how to approach this.

My friend is a US Born Citizen and met a Canadian citizen. He currently lives in NY and his girlfriend in Canada. They met while she was going through her training in the US. They wants to get marry but not sure how the legal process work. Currently, She visits from Canada once a month for a week or so and return. In return, he also visits Canada for a few days here and there. there is no type of visa that is required for their visits.

After going through the process, I know its illegal for her to come to the US and adjust status that way so therefore, that's why I recommended for him to apply for K-1.

1. Is there a duration of how long they have met to apply for the I-129f? From what i've read, its 2 years?? please correct if I am wrong.

2. If the process require at least 2 years for them to know each other before submitting the application, what option does he have if they've only known each other for 1 year?

11/10/10 - Filed AOS at Chicago lockbox
11/12/10 - AOS package received
11/17/10 - NOA1
12/27/10 - Biometrics --> canceled due to snow condition
1/18/11 - Advance Parole approved
1/26/11 - Biometrics Completed
1/31/11 - EAD in production
2/7/11 - EAD Recieved
2/18/11 - Applied for SSN
2/28/11 - Received SS Card
8/5/11 - Interview letter mailed
9/8/11 - Interview @9am
9/9/11 - Card Production
9/20/11 - Received Green Card

7/2013 - Submitted Removal of Condition

9/2013 - Biometrics Completed

11/20/2013 - NOA1 - Request for Evidence

12/20/2013 - RFE returned

1/2014 - 10 year green card approved.

they would have had to have met within a 2 year span prior to filing the I-129F.

So, if the I-129F was filed (for example) on 4/15/2014,

then sometime, anytime, with a 2 year span going back to 4/15/2012,

they would have had to have met 1 time.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

It doesn't require 2 years of them knowing eachother; it requires that they have seen eachother in person in the last two years. It's to prevent mail order brides or childhood family friends filing for eachother.

Your friend qualifies on that front :)
