Is it for real what the lawyer said about the requirements is case to case basis?, because my husband just went to the lawyer and he said that the requirements are case to case basis and asking us to wait for the mail that the NVC sends., we already got our nb case number as well as the IID., and an email from NVC. We already pay the aos and for the pocket IV. We already saw the requirements here at vj and just to make sure that everything is there before sending it that's why my husband went to the lawyers office. He waited for the lawyer almost 2hours, then all he said is to again "wait for the mail and the requirements are case to case basis". Now my question is is it really case to case basis?or should we send the aos and the IV pocket?we really miss each other and want to be together., all of these makes us sick., and I'm getting depression already :| "just exaggerating. :) answer/suggestion pls.,

'wait for the mail'

is stupid.

why? it extends the time the casefile is at NVC.

The instructions for what to do, how to do,

are

actually IN the NVC Payment Portal.

It smells to me like the attorney is stalling the submission of the documents into NVC, for whatever reason,

or

is so old fashioned that he/she never learned about how email contact works with the petitioner/beneficiary at NVC. This 'wait for the mail' ####### is only that - #######. Sure, NVC still does it - it's called 'postal processing' and most readers at VJ, instead, follow the NVC HOWTO in the wiki section here (it shaves months and kills the postal processing inclusion at NVC).

How about giving up to your lawyers waste of time it seems that he just let you sit outside at the very cold temperature waiting of nowhere. Base on your statement you already have the NVC case# &IIN which is good to go if you the petitioner you can do make a payment now if u want as you know and also you can change your plan whatever you want

Have you did the ds261? Make yourself to appoint as a petitioner all correspondence will directly forwarded to you.

Yeah we already pay everything and it's already cleared., we received email from NVC asking bout the aos and IV pocket., that's why we are really really disappointed with that lawyer., :(

Si., yes..,, oo.,, I agree!! Even on paying the bill he didn't told us, we just did it., my husband went to his office so that we can at-least use his service or whatever., but my goodness..,, huh ??? such a disappointment., now we are thinking to send the requirements all the way to NVC without telling him.,, we'll see next what happens., I bet next is he'll gonna call and ask for his payments.,, ???

important thing all correspondence letter will forwarded to you, tell your husband to call NVC request himself to be the agent so That you will see what exactly goin on it is time to address this matter on your behalf,had no time to play with that idiot lawyer let be waste his time on you, not both you fooling him around so be stand on your way,this is really tough decision you gonna make hold on to it

i say to change the agent,

at this point in time,

is not necessary, at all.

instead, can generate the coversheets at the portal,

then:

1. send in the AOS set (I-864 + stuff)

2. fill out a DS-260 online

3. send in the civil docs plus any other bonafide marriage evidence you wish

and be done.

re-assignment of agent is not needed, as :

1. instructions and coversheets are in the nvc payment portal and

2. I-864 is downloadable form

3. status is viewable online or

4. status is sent via email.

that's it, that's all, no need to re-assign agent (which can take upwards of 30 days and slows down the casefile processing) .

aireen - here's an idea -

if you do all of that, then you and your husband have done the prep work of the attorney,

and

IMO, should ask for a partial refund of fees,

if the fee paid included NVC doc intake/visa application/document preparation. You can ask for this directly, after filing, or submit an invoice for the partial refund. If the invoice is neglected after 90 days, your husband can sue in small claims court for the fees.
