SSA typically does not issue an SSN until the child is EAD. In the interim to file your taxes and claim dependency, you will need to get an ITIN. This is done by filing a W-7.

And, according to the Social Security Administration, you attach the W-7 to your tax return.

I assume you are talking about filing your income tax return. Without a social security number your tax return will be held up. Contact your local social security office immediately about obtaining a social security number for the 14 year old. Of course, I'm assuming he's here legally and just waiting for his green card.

Unless the boy has EA from the USCIS he does not qualify for a SSN. As other posters have written, he needs to submit a form W-7 application for an ITIN along with the parents' tax return.

Not impressed with the "assuming he's legal" trip. What part of my question did you not read HappyGuy? I have already said CHILD is K4.....if you checked my signature you would not have to assume anything.

We filed last year claiming my (now 11 year old) stepson. It was no big deal... we simply did as others have suggested and attached the W-7 to our return. It was processed with no problems other than I made some mistake and we got back more than I thought we would! And now he has an ITIN number to use on our returns from now on...
