AOS Denied on spurious grounds

Thanks mate you would think after 50years married first time I would have learnt my lesson...A slow learner eh!

Not at all. We all need companionship.

Some of us need more than one shot at getting it right, myself included.

I got it right the first time wife passed away so decided to take a second shot before they throw in me in the box...lol

I thought that might be the case, but the way you were joking about it sounded like you had gotten divorced. I took a gamble and lost.

50 years is a very long time to spend with one person and doesn't happen all that often these days. My hat goes off to you!

Thank you mate good luck to you and thanks again for the support...the wife and I need it at the moment as we are still down over the "Denied Status" but am sitting filling the application again and getting a new package together

I entered the US on 19th Oct, we didn't marry until the 14th Jan. We were TWO DAYS away from my K-1 expiring. Sent off AOS on Feb 5th, and we have had no issues, interview date set for next month. It's not recommended to be sitting without status between K-1 & AOS, but 9 times out of 10, it's not a problem - as long as you got married within those first 90 days of setting foot in the country - it's a shady area.. Perhaps what you should have done was call or email USCIS and asked those questions directly.

But all said and done - I wish you better luck with the new package!

First Level Telephone operators at USCIS, the CSRs, are contractors from SERCO

and are not trained on any issue, much less to answer questions.

They will read a script, and look up a case and give the same status that can be found on the uscis website. Their access on the computer system is limited, and

they keep their seat by making quota on the # of calls they take each hour, and

make up sh|t all the time in an effort/attempt to get you off the phone.

I would never, ever, recommend anyone to call into USCIS National Call Center to get any question answered, unless it's status.

Email? Ain't no such thing. Sorry.

Now, with all of that said, getting a Second Level Human, an ISO, a Tier 2, is useful if'n you have problems. It's a slog, be on hold anywhere from 1 to 4 hours. Useful, though, if'n you need it, as this type of human has full access to the computer systems, and can handle almost everything that an Immigration Officer at a local infopass appointment can handle.

So, for yer advice, right there - I'm terribly sorry - it's wrong. I ask you not repeat it in the future.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Waited 7 years. Spent several thousands of dollars.

Look at how far the case went before the denials for submitting a petition without meeting the requirements.
