A friend of mine went to the interview with her fiance and was told by the consulate that they are sending back the case to USCIS and they gave her a form 221g. She is very confused by this. She did say that after the interview they were told to have a seat and wait, they waited for three hours then was called to window 13, fraud investigations unit. They were interviewed separately and asked questions about why they didn't get married, about their sexual relations etc, then was told to wait 20 mintues and then they said they don't believe the relationship is real, and that the office thought they were together for immigration reasons only. They told her they will send back to USCIS for revocate or reaffirm the petition. On the 221g form it states that they are returning to USCIC because of inaccurate information and wait for a response.

What do you think could be the inaccurate information? About how long will this process take? I am just trying to help my friend. Thanks

9/01/15 Card in production, Welcome notice has been mailed

9/05/15 Welcome Notice Received

9/08/15 Greencard was mailed

9/10/15 GREENCARD RECEIVED!!!!!!!!

7/1/17 I-751 returned rejected (multiple items)

7/3/17 I-751 mailed again with signature confirmation

7/6/17 second I-751 delivered and signed for by Daniel Manchaca

7/10/17  Check Cashed

7/10/17  NOA

7/22/17  Biometrics letter for 8/2/17

8/02/17 Biometrics appointment DONE

3/05/18 case moved to local office

8/25/18 Extension letter (18 months)

9/29/18 service request submitted

10/06/18 response to service request

10/11/18  approved. No RFE, no interview

10/16/18  approval letter received in the mail

10/19/18 greencard received

Inaccurate information means that they answered important questions differently from each other.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

Not good at all being already called into the fraud investigation. They had what is a Stokes interview. And they didn't match up at all. They have a uphill climb for sure.

This is a K1 so more than likely there won't be any reaffirming of this it will go back to USCIS and expire and they will have to either refile if it is denied without prejudice or they get married and file a I-130. But if they think fraud that's big. They should seek a lawyer soonest.

Timeline

It seems they contradicted each other in the initial filing and when they interviewed separately it went from worse to worser.

You did not say what country this took place in. Countries with a high fraud rate have a more jaundiced eye when they spot inaccuracies. And when the petitioner and beneficiary can't give consistent answers to the same questions when asked in person, that pretty much seals it.

If she is at DR still, best option is no wait for answer, and get marry now, and start rhe process for I-130

If they were interviwed at window 13, they willl denied at uscis.

Best option is dont waste time waiting uscis answer and get marry now.

If they get marry now, they can save time.
