My answer is based on I am under the assumption that you are applying for a spouse that is currently living in another country and you are not both living here in the US....

This shows the required forms -

I put in bold the requirements you have listed that you need to send for the I-130. The other items that have to do with the beneficiary or AOS are not a part of USCIS process. Beneficiary information is required at the NVC process when they beneficiary fills out the DS-260 application and you fill out the I-864 AOS.

Marriage certificate doesn't have to be an original or a certified copy for the petition filing. Only for the NVC. Also in the instruction you're also providing a link to they ask for a copy of the naturalization certificate - not a certified copy. When they want certified they mention it explicitly.

so should I not send aos for now? a guy from the forum said I should not send this way he said just send i-130 payment and g325a forms with photos, he told me not to send originals to USCIS. what should I do? I was thinking USCIS will forward everything to nvc once they approved our application, does it not go that way?

If you send originals they might not forward them to NVC and then you will either get new 'originals' or certified copies or fill in a special form called "Return of original documents" (Saylin's post with link). Basically, no originals of documents (except forms you send in) are sent to NBC.

And i forgot to mention: if you need translations, they have to be certified by translator (saying they're capable of translating and giving their name, signature, translation date and contact details). Doesn't have to be done by a professional interpreter, though. I did ours, worked out fine.

Marriage certificate doesn't have to be an original or a certified copy for the petition filing. Only for the NVC. Also in the instruction you're also providing a link to they ask for a copy of the naturalization certificate - not a certified copy. When they want certified they mention it explicitly.

I sent in my I-864 with my I-130 and now I am at the NVC stage and have to send it again, so it doesn't matter but you going to have to send it all over again.

One thing, make a copy of everything you are sending for yourself.

##9 and 10 do not belong there. Please read the instructions for filing here. Do not send any originals of marriage, birth, police certificates at this point. USCIS only requires copies. You will need originals for the NVC. They are sent separately and additionally after the petition is approved. Affidavit of support is also only sent to the NVC. By the time petition gets approved you might need to update some paystubs and such anyway because it takes a while. Police certificate also eventually expires.

Again, i say, read the instructions. Don't send everything off at once.

And also: #12 - which future use do you think there could be?..

And also: you want to add translations for whichever documents are not in English (if any).

I also would agree #9, 10, 12. Well put together packet but it was to much info. in the beginning. When you submit to much in the beginning that is how a lot of people receive RFE's. I second that "Read the instructions. Don't send everything off at once." If you do what evidence will you be able to supply in case of an RFE? All that is needed is what is asked for by USCIS http://www.visajourney.com/content/i130guide1 "Assembling the I-130 Package and Evidence of Bonifide Marriage." Also 1 passport size photo. This comment is for people that is filing initially.

  • Copy of Divorce Decree of previous marriage (petitioner)

  • Passport style photo (beneficiary)

Evidence of our Bona Fide marriage:

  • The Story of Beneficiary and Petitioner: a brief story explaining our relationship history, marriage, and future plans together
  • Copy of “Proof of Beneficiary” form for IRA form showing "beneficiary spouse" as primary beneficiary
  • Copies of 2011 & 2012 joint tax returns – Federal and state

never send originals to the USCIS - you may never see them again. Photocopies only. Remember your photo pages should be the size of a normal sheet of paper. It's easiest, generally, to print photos on letter sized paper and send those.

Case Complete to Interview spreadsheet
