Ok, but my accountants are saying that they cant just do that otherwise anyone could just say ok hey I have some dependants, and put anyones name on the returns.

What if I am trying to amend the original that I filed as single?

I think your accountant is so confused. If I were you, I would fire him/her. You can use an online version of TurboTax (or any other software) enter your info, check the box that says file as MFS (married filing separate), print out your return, write NRA in the box where it says Spouse's SS#.

Remember to amend your original tax return, you are submitting a 1040X - Amended US Individual Income Tax Return. The only amendment is Filing Status.

Then later on when your Spouse has the SS#, you will amend it again.

The other option is not amend it now and wait till spouse has SS# to amend. But then be ready to explain at the time of interview as to why you filed as Single when you were actually Married (Accountant confusion and error).

With respect to your first sentence (anyone could ...), here we are talking about two people who are legally married with Marriage Certificate and all that. Does not matter where on the planet your Spouse lives, he/she is still your Spouse.

Ok guys! i was so worry yesterday bcs of this topic, n i called 3 of my friends from colombia that they did same process CR1.... n the 3 persons, they said... them husbands did the taxes as single.... for the same reason some of us did... the person who help us the taxes, they say, we have to do like single bcs we dont have the social security number.... finally my 3 friends dont have anyproblem in embassy in bogota colombia for this reason....

Same time my husband talk yesterday with NVC and he said how we did the taxes as single n why, and the person there said, no problem and that a lot of people do that way.

If NVC said is not a problem, and 3 of my friends that did same process few months ago they r in USA without anyquestion about from embassy, where is the problem? i think we just get worry to much for nothing

Very interesting, and long, post! It was a good read and that does sound nice, but I think I will just go the married filing separately route in order to save some time. Hopefully the amendment will go good and not delay anything.

It seems pretty clear that if I am filing married filing separately I do not need to get an ITIN number.

Am I missing anything?

My husband (USC) filed his taxes MFS and he had no trouble. He did the filing himself, printed the form and entered "NRA" then mailed the printed form. He had no problem. He received his returns in March and was able to use it to start the I-130 filing.

At first he wanted me to fill out the W-7 form and mail it to him for his 2013 filing but we didn't go that route based on the expert information we read on VJ. Next year howerver (hopefully I will be with him then) we will be filing MFJ.

i called NVC just 2 make sure abt this filing single. They said if u have your income above poverty line there is no problem. MEanwhile i asked if CO asked my spouse y ur husband has filed as single they told me they never ask this they know everything and if they do ask u just tell my name and id of nvc agent or just tell them u will always gonna amend it once your wife is here. SO i had her id # no worries.

On 11/20 the representative told me that the BC needed to be inextensa and the marriage license. True enough I had sent an extracto. But requested a supervisor review bc I knew the marriage lic was inextensa. 2 days later called again and got the same supervisor who told me that the marriage lic needed the proper signed legalizada (sticker on the back)

Sent necessary documents/Received: 11/20/14 and 11/26/14

Called 12/15/14: got Arthur....after he checked and verbally spanked he sent me to supervisor Silvia who said she would pull my file and try to figure it out.

Case complete: 12/19/14 Sylvia called and left a voicemail, called and confirmed later that night and status changed to N/A.

Filing as single and then amending later, while not technically correct, actually does work, every time I've heard of it being tried. Consular Officers are aware of the problem, so don't ask this question. First they don't expect the beneficiary to understand anything about US taxes yet and second, they already know the answer to why you filed single.

Facts are cheap...knowing how to use them is precious...

Hi everyone,

So, my husband filed taxes as single and we sent all our documents to NVC, we got our case complete last friday , we are now waiting for our appointment date to be assigned by the embassy.

I just got off the phone with NVC and asked if he needed to fix his taxes and the representative answer me with a "duh" like kind of voice and told me it was not necessary, he is not supporting me financially in any way and even if he does I'm not in the country, so it was not necessary to amend his taxes.

Just sharing the information I got just now :)
