Attending a funeral in UK on K1 Visa? HELP

Hi Guys,

I'm in the terrible position of being on a K1 visa having just found out my Nana has died in the UK. I'm aware, after being told again and again at the border when I entered the US, that I was only allowed one entry under my K1 visa. I was wondering if any of you have been able to obtain special permission to leave the country for a funeral in the UK, and if so, how did you do it? My fiancé and I have called USCIS and the border agency today, but haven't been able to get through yet.

Any advice and help would be appreciated.

Get married if you haven't done so. Make an infopass appointment. Request an emergency Advanced Parole. Bring proof you Nana passed away.

If you have not yet married, and are in the 90 day period still, there is a way to get the K-1 reinstated at the embassy. They could only get it reinstated for the original 90 days, but it is possible.

Marrying and getting an emergency AP would take at least a month, I would guess.

You have the option to file for emergency AP after you are married. A death in the family qualifies as an "extremely urgent situation", hence the emergency AP. Go to your local office to request an emergency advance parole document. When visiting a local office to request emergency advance parole, you should bring the following items:

  • A completed and signed Form I-131, Application for Travel Document
  • The correct I-131 filing fee
  • Evidence to support the emergency request (e.g. medical documentation, death certificate)
  • Two passport-style photos.

To apply for an emergency AP you must file Form I-131, complete with supporting documentation, photos and applicable fees. After you've prepared all these make an info pass appointment. You must apply for the travel document before leaving the US. Generally, an applicant for AP must also complete biometrics at an ASC prior to departure from the United States. Failure to do so may cause the applicant to lose permission to reenter the country and lead to the denial of any other applications pending.

This is true....but not guaranteed. Email the Embassy, they are the only ones who can do this.

Sorry for your loss.

Do not bother with getting married, and filing for AOS and AP. That will take far too long. Since you have not married yet, getting your K-1 re-issued is your best path. Contact your consulate about it.
