will My daughter have to leave the US ?

Hi,

I really need your help :

ON OUR SIDE

In 09/1998 : My husband and I moved to the US under a visa L1 with our chlidren. 6,18 years old . My 18 years daughter started the University as a freshman.

My husband is working for an International company, and after 2 visas renewal, the company filed the paper for a Permanet Resident card for all of us, except my daughter because as that time she just turned 21.

-08/04/04 : My husband, I and my son obtained our Permanent Resident Card (green card)

- 12/04 : We filed a I 130 for our daughter (who was over 21 when we applied for our green card)

- 07/20/05 : We received an Approval notice (I197) for our daughter.

ON MY DAUGHTER SIDE

- From 12/1999 to 07/2003 : My 18 years old daughter studied and graduate in the US. (she lived with us) She asked for a F1 visa (to be sure to be able to get her diploma in case we have to come back in France before she graduate). She graduate in Mai 2002 and found a job in august 2002 under her 1 year working training. Her company hired her and sponsored her visa.

-Since 07/2003 : She is working in the US with a visa H1-B (renewed until 2009) no further renewal possible. (The company will not pay for the worker green card )

- 07/20/05 : We received an Approval notice (I197) for our daughter.

From What I understand. We have now to wait until a visa number became available. Right now the Visa bulletin is saying they are giving visa number for people with a priority date of april 97.

As my daughter is having a Dec 2001 priority date on her I130 approved petition, she will never get her green card in jul 2009 (end of Her working visa).

Is that mean she will have to come back in France (where she has no job, no family, no house )

Tell me there is a solution, please !

Easy peasy:

Find a USC Fiancee.

Or an employer who will sponsor her for a GC.

Ok for the fiance. (not in her priority)

Ok for an amployer sponsoring GC . But it's not easy to fing and The wating time for a Green card with an employer when you have a H1-B visa is very long too, and you have to stay with the same employer during the prossess. She already works with her company for 5 years. It's her first job and she would like to change, but she is stucked with the visa H1-b.

Any other solutions ?
