I am very depressed.

My wife's approval notice for her EAD was lost and DHS will not issue another because it was not returned to them as undeliverable.

It is either USCIS or the USPS who is to blame. I see no way it could be our fault if USCIS has our correct address and the USPS delivers most of our mail.

I filed back on 10/06/05 and the EAD was approved on 01/24/06.

There is a possibility her interview may not happen if we never receive that letter.

I can't afford to put out $180.00 or $330.00 every time we fail to receive a notice.

This is the second time it has happened.

My step-son's biometrics notice never arrived and I had to see a Congressman.

The Congressman's office was not very optimistic about my wife's EAD and told me basically what DHS said.

I need to refile.

I wrote to my Senator but I'm sure it will do no good.

I am tempted to use an attorney but he will charge an arm and a leg.

What can be done if the USPS or DHS are always losing your letters?

Sorry if I am rehashing this story over and over again, I just feel as if we are doomed.

Yes but the EAD was mailed from Missouri. It could have been lost anywhere in between.

My local Post Office swears that they have no problem with mail delivery. I spoke with the USPS manager several weeks ago and her search turned up nothing. I even spoke to my mail carrier and he had seen nothing. Where I work, if a notice is lost we will send another at the customer's request.

That really sucks. Was it just the notice or was it the actual EAD card itself? Back when we filed (a few years ago now) our office (San Francisco) made us go in person to pick up the EAD. Now I appreciate them doing that when I think about things getting lost in the mail.

If it was just the notice telling you the EAD has been approved and to go pick it up, they should let you pick it up anyway. If it was the EAD itself, then that's really rotten. I'm sorry.

We had a similar experience. We scheduled an infopass on Feb 15th hoping to obtain an interim EAD since it was long overdue and we'd never even had biometrics done for it. Instead, we were told that not only had the EAD been approved on the same day as the AP, but it had also been mailed out to us on Jan 4th (mailed without bios taken?!). Of course we never received the EAD in the mail, even though the AP reached us just a cpl of days after it's been approved.

Obviously, the only advice we got from the infopass officer was to reaply for the EAD! Fortunately, we didn't have to deal with it anymore, since our AOS was approved shortly after...

I would be willing to bet that the stupid EAD never even left their office.

I swear that it is the USCIS that loses these papers and they just blame it on the postoffice... they lost my AP and of course refused to reissue it unless I paid up again. I figure that since they get to charge a whole new fee for nondelivered items they don't care! Once the computer says something has happened so far as they're concerned that's it.

I have good news but don't know if it lets DHS off the hook so easy.

We found her EAD and letter, it was postmarked January 26.

Both of us thought it was nothing special because it was in a plain white envelope.

It looks like a replacement credit card may look with very little printed on the envelope.

Nowhere does the USCIS - DHS logo appear on the envelope.

The dead giveaway was the Missouri postmark.

She was ready to throw away the envelope thinking it was junk mail and I had told her it didn't look important. We are both very happy and I am embarrassed too.

Make an infopass appointment and try to get them to give you an interim one? My guess is they'll turn you away saying its already in the mail, but you might get lucky and they'll give it to you...

As for getting an attorney, dont waste your money..they woulnd't be able to do anything for you anyway.
