My wife on a tourist visa. We are almost ready to submit her documents to adjust status. We plan to submit forms 485. I130 , I131 , and I785. On one of the form it asked if she had submitted to us government a petition before. The answer is yes her mom did 7 yrs ago and she would of probably had a interview at us embassy Guatemala in June or July this year but we decided to get married since we knew what we wanted.

Ok our lawyer is advising us to answer no on the forms because it will slow the process and make it much longer . She said they would require all the old forms. She said better to answer no since the departments are totally seperste and work seperately . She gave us examples where someone got married adjusted status and then got emails yrs later from their original petition for interviews etc and happens often.she said if she is asked then just blame on her and say we didn't notice she checked no. I am thinking to check no and do if asked blame on our lawyer and say we didn't notice it but be honest if asked . What do you think ?

4-11-2014 - Sent I-130 , I-485 , I-131 , I-765

4-14-2014 - tracking number verified USCIS received package and signed by L.CHYBA at 10:57 pacific time or chicago 12:57

4-17-2014 - received text msgs 4 all 4 forms and emails for all 4 forms that they were accepted confirmation.

4-18-2014 - USCIS withdrew funds from my account

4-26-2014 - Received biometrics letter

5-14-2014 - biometrics completed

5-19-2014 - sent info to Senator to expedite work permit EAD

5-22-2014 - I485 changed to testing and interview status

5-29-2014 - EAD work permit went into production

6-3-2014 - EAD shipped with tracking number

6-4-2014 - Messages EAD delivered

6-5-2014 - applied for SSN

6-13-2014 - received SSN

7-9-2014 - received notice mail sent of interview date for 8/14/14

I think your lawyer is telling you to lie which risks a lifetime unwaiverable ban.

There is no harm in telling that truth, it will not hurt you in the slightest. And your lawyer is also wrong, both petitions are lodged with uscis which is the exact same agency.

Answer yes and get a new lawyer.

The mom's petition for a daughter will not affect nor be needed in any way for your filing. They will not ask for copies of Mom's petition as it is already in their system. By lying you will be raising huge red flags on your case which could result in a life-time ban.

I hadn't replied to this yet and just read the responses. to those that responded I knew what the answer probably was and you answered exactly that I was thinking so thank you for your valuable opinions !!! you do make a difference
