My attorney suggested we miss the appointment we were awaiting more documentation on DV how serious is this.

Your attorney seems to be complete idiot, no reason to miss biometrics while waiting on documentation. I would fire him immediately. If you petition gets denied, you loose your status (can't work), have to re-file and pay the fees again.

You need no documentation beyond the appointment letter for the biometrics so your attorney gave you bad advice there, if your attorney wrote to them in January then just when was your appointment? They usually give you less than a month's notice so has your appointment long since passed? If so then your case could well be already denied, it is okay to miss an appointment due to some missed mail or something but April was some time ago already so it may already be too late to try to reschedule.

What documentation were you waiting on anyway and are you sure it was for biometrics and not an interview for the ROC? Most cases don't need an interview at that stage but it is possible yours did.

You don't need any of that documentation for the biometrics and skipping it without confirmation could well lead to your case being denied if it isn't already, your attorney should know this.

You need to get in contact with USCIS yourself and find out what your case status is, hopefully your lawyer has shared your case number with you so you can do that. Firstly I would check here using the receipt number - https://egov.uscis.gov/cris/Dashboard/CaseStatus.do and then dependent on what that says I would call them and ask to speak to a Tier 2 Immigration Officer so you can see what is going on with your case.

Your biometrics appt two weeks after applying is the normal timeframe. That has NOTHING to do with providing more information. However, missing your appt without a new appt is the same as abandoning the application. They will reject due to no biometrics, a required step in the process.

If you don't show up without rescheduling, the petition is considered abandoned.

Not sure if there's any going back from that, aside from refiling.

Contact USCIS immediately and try to reschedule it. As in, right now!

I believe you also have a case for legal malpractice here. You're attorney is incompetent.

Yes,

You should immediately contact USICS and reschedule your appointment.

Also, On the other hand, I would also suggest you to visit your biometrics office location and try getting your Biometrics done.

Just carry the Biometrics appointment letter and give a good reason on why you missed your appointment earlier.

Wont hurt trying!!
