can one take advantage of RFE to add more evidence of relationship?

my fiancee sent our petition just two weeks after she delivered our first child and no evidence concerning our child is included in our petition, and also considering the fact that our country is 'high risk country' which implies that more evidence is needed.

There is chance for us to get RFE, so I'm just wondering if we could 'SIDELOAD' since we did not FRONTLOAD in the first place?

If you get an RFE, then send in more evidence. Send what they require. If it is more evidence, send that.

You can always send in only what they ask and leave the rest of the evidence for the consular interview stage.

Don't send in things if you do not get an RFE.

Trust your instincts and send it in. As a K1 I sent in additional evidence at the USCIS stage after months and this was without an RFE. There were many people that said i shouldn't because of various reasons.Some said it wasn't asked for or it won't make it in your packet or it will seem suspicious.You should of course take evidence with you on day of interview; However, we are dealing with Nigeria and if it is not in your packet at interview ,it probably won't get looked at unless it is asked for. I followed my instincts and sent the evidence anyway.Long story short,all evidence sent was in our packet on the day of interview.

Oh, just wanted to add ,all i did was use my NOA1 as a cover and included a cover letter explaining that i had additional evidence i had forgotten to add ,everything was sent via fed ex.

If the child is yours, then not sure why she did not list the child on the I-129F where it asks you to list all the children of the foreign fiance(e). They probably will not send an RFE because they will not know that children were listed that needed to be. She can either fill out a new I-129F and add the child where it asks for them to be listed, along with an explanation of why she is sending a new updated form and documentation and hope that it makes its way to your case file, or just have you take the updated I-129F and evidence of your child together with you to your interview.

If you do send in something without an RFE, make sure to list your names and receipt number on what you are sending in, and include a copy of your NOA1 receipt notice to give the best chance for it to make its way to the case file. Send it directly to the service center processing your case and not to the Dallas lockbox where you mailed the petition to begin with. It may or may not make its way to your file.

Receiving an RFE is an absolutely golden opportunity to "side-load" (great term). Others in your position should be so lucky as to receive an RFE. Be sure to respond to the RFE itself, of course. Add the extra material with a cover-note saying "extra evidence for the Consulate."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

RESOLVED-

We got rfe and took the opportunity to add remaining missing pieces of puzzle. We answered rfe and also added our son's picts, birth certifacate and filled page 3 (information on fiance's children) then put a note on it that we mistakely omitted that part. We got approved week after, our petition is on it way to Lagos now. so after interview I'd know if its included or not but I'm very positive that its included.
