Hello everyone!

I would like to know how I can become a Brazilian resident through marriage. If I have my U.S marriage certificate legalized in America and then registered in Brazil, how is the process after that? Also, if the residency process takes more than 3 months, how bad it will be for me to still be in Brazil with a tourist visa?

Adam, do you speak Portuguese? The info I have is in Portuguese.

Here is some information from the LA consulate website: http://losangeles.itamaraty.gov.br/pt-br/casamento.xml on how to go about registering your marriage and then applying for residency. It's a very long process.

Actually, you'd have to ask the "Policia Federal" to extend your tourist visa. It's good for 10 years but you can only be in the country for 180 calendar days in one given year. I have heard that you can get this extended by the "Policia Federal". Perhaps you can call or email or google the answer?

Hi Adam, we did this process to my husband couple years ago. He was able to stay in Brazil with his tourist visa during the process. Your wife needs to prepare the documents for you. If I can be of any help, PM me.

Good luck! Its a long process but at least you can stay with your wife. Too bad United States is not the same :(

Permanência definitiva com base em cônjuge brasileiro ou prole brasileira

O estrangeiro casado com brasileiro ou genitor de prole brasileira poderá solicitar permanência definitiva no Brasil ao amparo do artigo 75, inciso II, da Lê i nº 6.815/80 c/c a Resolução Normativa nº 36/99 do Conselho Nacional de Imigração.

Requisitos exigidos aos interessados:

  • possuir capacidade civil, segundo a lei brasileira;
  • estar casado de fato e de direito com cônjuge brasileiro; ou
  • possuir filho brasileiro sob sua guarda e dependência econômica.

O artigo 75, inciso II, alíneas “a" e “b”, da Lei 6.815/80 dispõe que será inexpulsável o estrangeiro casado de fato e de direito com cônjuge brasileiro há mais de 5 (cinco) anos, bem assim aquele que possui prole brasileira sob sua guarda e dependência econômica.

A permanência concedida ao estrangeiro que possui prole brasileira persistirá enquanto o filho estiver sob a dependência social, moral e econômica do interessado.

Se o casamento ou o nascimento da prole brasileira foi realizado no exterior, as respectivas Certidão deve ser transcrita no 1º Ofício de Registro Civil do domicílio do casal, nos termos do § 1º, do art. 32 da Lei de Registros Públicos – Lei nº 6.015/73.

Documentos necessários à instrução do pedido com base em casamento com brasileiro:

  • Requerimento próprio, devidamente assinado pelo interessado;
  • cópia autenticada, nítida e completa do passaporte (inclusive das folhas em branco) ou do documento de viagem equivalente;
  • cópia autenticada da certidão de casamento;
  • cópia autenticada da cédula de identidade brasileira do cônjuge;
  • declaração de que não se encontram separados de fato ou de direito, assinada pelo casal, com firmas reconhecidas;
  • declaração de que não foi processado ou condenado criminalmente no Brasil e nem no exterior, e
  • comprovante do pagamento da taxa respectiva.
