Hello Everyone,

So my story in short is that I was here in the US on J1 visa, found a girl, both fell in love and then the time came for me to leave. We decided

that we wanted to stay together, got married, moved in and started the paperwork for AOS. Months later received green card, and relationship

became terrible. I'm not trying to blame it on anyone, but her personality turned to the opposite, than she presented earlier in our

relationship. Our marriage became very draining to me, she gave me the silent treatment, then found out she cheated with multiple partners. After

some research I've found out about the Borderline Personality Disorder and all of the traits were very similar to my wife's. I've talked a lot

about this with her family and they could understand me and supported me. Found out that her family has had a hard time with my wife too.

A few months later I couldn't stay with her anymore, I had to leave, so I went to another state to stay with good friends I knew and started

working there. The next year we have done a joint tax return with my wife and months later, we have filed for divorce, got that done too.

I know that my situation looks like I was trying to gain immigration benefits through her, but to be honest, this really wasn't the case. It was

my mistake, that we got married too early, I didn't know her personality enough. However in the time we got married, our relationship was

passionate and legitimate.

Now time is getting closer to the 2 year window and I've got comfortable here with my life and work. I understand and accept that I might not be

able to get ROC done, but if there is a way I can stay, I would.

Paperwork we have together: a few months of joint car insurance, joint bank account statements, joint tax returns, lot of pictures, affidavits,

utility bills, divorce decree.

Would appreciate any advice or comments on my situation.

The 2 year window doesn't apply to you once your divorce was final. I hope it hasn't been more than 90 days. You need to file now not at your 2 year date. You will need a divorce waiver to file a removal of conditions also. Look that up.

Get that paper work in now. But marriages fail, that's a fact. Just show what you have you should be fin.

I had my AOS Interview last month, which was successful... as we walked out my attorney said he needed a discussion with both me and my husband. He said although it was wonderful news that I was granted a green card he had to discuss what happen between now and when I file ROC in the event of divorce or death. My lawyer said word for word what dwheels has advised.... if divorce does happen you need to file ROC immediately.

Mimoclicious is also correct... Don't beat yourself up... marriages end every day and you should not worry that this will be a reflection on your integrity or honesty. I have been previously married and I knew very early on in the marriage that I had made a HUGE mistake. I left after 3 years, and the divorced 2 years after I left. I was lucky enough to find real love and second chance of true happiness later on down the road. We all deserve that. You deserve that. Listen to dwheels advice on filing ROC now. I wish you all the very best.

There would be no harm in having a consultation with a reputable immigration attorney. Some may even offer free consultations. I hired an Immigration Attorney for my whole visa process and he will also be filing my ROC. Its a personal thing. Lots of people don't need an attorney, I found it less stressful having an attorney. Good luck.
