Need to file taxes as students? (CR-1)

Hi, my wife and I got married in 2012 and came to the US in March 2013 by getting CR-1 approval. We are currently both students so we have no income. Do we still have to file taxes? I have been getting mixed answers from people and I do not want this to be an issue when I file for Removal of Conditional Status (I-751). Thank you!

If you have no income then you are not required to file taxes, but you can file taxes. You won't have to pay if it is all zero, obviously.

You can check irs.gov for "who must file."

Timeline

For what it's worth, my wife and I had no income in 2012 and we didn't have to file a return for that year so we didn't have 2012 taxes to send with her ROC. She was approved without any problem. Also, the 2011 tax return that we did send with her ROC form was just the tax software printout of our tax return and not an IRS tax transcript that so many here claim is mandatory.

N-400

Feb. 12, 2016 - Sent N-400 to USCIS (3-year rule)

Feb. 19, 2016 - NOA1

Mar. 14, 2016 - Biometrics

June 2, 2016 - Interview - Recommended for Approval
