I just receive a checklist from Nvc it says

__________ income indicated on the I-864EZ Part 19 does not correspond to that shown on the most recent tax return and W-2(s).

I just copied what's on my W2?? am I doing something wrong?? does it have to be what's on my 1040? I gave my w2's for 2010,2011 & 2012.

They advised me that since my case is complete I have to send a new copy of filled out I864EZ to my husband for his interview. Has anyone have this issue before?

You need to report the 1040 income on that item:

if you filed a 1040 (or 1040A), then use total income, and if you filed a 1040EZ, then use adjusted gross income.

03-04-2014: AOS payment email from NVC


03-05-2014: AOS invoice available on portal; AOS paid


03-06-2014: DS-261 in NVC system awaiting review


03-07-2014: AOS/I-864EZ packet express mailed to NVC


03-08-2014: Received hardcopy in the mail from NVC stating that my K3 Visa application was closed due to the I-130 approval


03-10-2014: AOS shows "PAID"


03-10-2014: AOS packet arrived at NVC


03-12-2014: AOS packet in the system


03-18-2014: IV invoice icon changed from locked folder to yellow exclamation indicating payment to be available soon


03-19-2014: IV invoice/agent email received; IV invoice available on CEAC few hours later; IV invoice paid


03-20-2014: IV Packet express mailed to NVC


03-21-2014: IV invoice shows "PAID"


03-21-2014: IV Packet arrived at NVC


03-21-2014: DS-260 Complete


03-25-2014: IV Packet in the system

03-27-2014: False checklist for IV civil documents. AOS Accepted

04-04-2014: Case Complete


04-11-2014: Case Complete Email


04-11-2014: Interview date assigned for May 22nd

You need to report the 1040 income on that item:

if you filed a 1040 (or 1040A), then use total income, and if you filed a 1040EZ, then use adjusted gross income.

No they are not the same.

Use the number on the tax return that was filled, not the w-2 form that an employer provides.

NO. This question has already been answered. For some, the "total income" from a tax return transcript and the number on line 22 of the 1040 will actually be the same as the number on the W2. However, the number they are looking for is "total income", so line 22 of the 1040 or "total income" from the transcript is the right answer. REALLY.

For example, your W2 COULD say you earned enough to qualify but you took a big loss on your side business, stock loss, sale of property or depreciation that reduced the "total income" to a number that would NOT qualify. Give them the total income number or simply never move forward an inch in your immigration process.

If your line 22 is lower than the number on your W2, it is also possible do not qualify to use the I-864EZ. If the total income is MORE than the W2, AND the W2 income alone is sufficient to qualify, you can use the EZ version if the other two questions are correctly answered yes. If your line 22 isn't enough to qualify, not only can you not use the EZ version, but you'll either need to make up each dollar of shortfall with three dollars in documented liquid assets or find a joint sponsor.
