Our background info -- My little introduction didn't get a lot of replies, so I'm posting here...:D

:help:

My wife and I are getting ready to send in the I-130, but I would like to obtain an EAD as soon as possible. For that, does my I-765 have to be associated with my I-129f (which, according to the guides, takes longer to get processed), or can I use the NOA1 to apply for the EAD (independent of the I-129f) at NSC? And if I can, do I need to file the I-129f at all?

Thanks, I really appreciate any inputs on this!!

Welcome. Please read the guides, it will really help you out :)

Are you planning on staying in the country to Adjust Status? It would be helpful to know what sort of student visa you entered on as some have a period in which you must leave the U.S.

If you are filing for adjustment of status (AOS), it is generally a good idea to at least have a consultation with an attorney who can make sure there are no problems with you filing. The guide for AOS explains all the forms you can fill out, including the I765 which can be submitted at the same time as the I485.

You will NOT file a I129F unless you are planning on leaving the U.S. to await your interview.

Good luck with everything.

Sandy

Hi riblet,

Thanks for the response! I came here on an F-1 (international student) visa in 2002, and it expires in July this year. I guess I'm confused about whether I need a K3 visa to stay here beyond that time, or whether I simply have to adjust my status. You're right, and I did download and print the guide for couples currently in the US, but somewhere along the way I assumed I need the K3. Would applying for AOS allow me to stay here legally even after my F-1 expires?

Would I also have to file the I-485 supplement? the form states:

You do not have to submit Supplement A to Form I-485 if you:

.

.

. Are applying to adjust status as the spouse or unmarried minor child of a U.S. citizen or the parent of a U.S. citizen child at least21 years of age, and you were inspected and lawfully admitted to the United States other than in C-1 or S nonimmigrant status.

Since I was admitted on an F-1, would that exempt me from filing the supplement?

Thanks again, everyone...you rock!

As long as there are no other complications with your case - which a brief consulatation with an attorney should clear up and be well worth, then you would just file for AOS (and EAD, AP, etc if you choose). No K3.

From the quote you've cited, it doesn't look like you would have to fill out a supplement - but I'm just basing it on that. I haven't really studied the I485 too much.

Good luck again.
